Dear Mr. Byrum:
15A NCAC 02D .0542 requires Albemarle Cotton Growers to submit an annual report
containing the name and location of the cotton gin and the number of bales produced the previous
year, signed by the responsible official, by March 1 of each year. As of the date of this notice,this
office has not received the required annual report.Note that your facility was issued a Notice of
Deficiency on April 4, 2019 for the late submittal of the required report.
This letter serves to notify you of the reporting requirements and that future late
submittals of the required report will result in this office issuing a Notice of Violation. Please
be advised that any future violation can result in possible civil penalties as per North Carolina
General Statute 143-215.114A. North Carolina General Statute (a) (1) and (2)provides that a civil
penalty may be assessed pursuant to North Carolina General Statute 143-215.107.
To assure that the report is received by the required deadline,this office suggests the
submittal of an electronic copy, followed by a hard copy,to meet the compliance deadline. I
appreciate your help in keeping the air in eastern North Carolina as clean as possible. If you have
