Box 449 Franklin,NC 28744 SUBJECT: Notice of Violation—Notification & Recordkeeping Requirements Harrison Construction Division of APAC Atlantic, Inc. -Murphy Quarry Murphy, Cherokee County,North Carolina Air Permit No. 08786R08 Facility ID No. 2000121 Facility Classification: Small Dear Mr. Mason: On February 25,2021, Steve Ensley of this office performed an air,quality compliance inspection of Harrison Construction's Quarry operation near Murphy,North Carolina. During that inspection,Mr. Ensley observed a portable screening unit that had not been noted during previous inspections. When he requested a current equipment list describing the new screening unit and its relation to other equipment at the site,the information was not available. Based on follow-up information provided by APAC-Atlantic, Inc. on March 9,2021, it was discovered that this equipment began operation on December 16, 2020. Specific Condition and Limitation No. 6(a) of Air Permit No. 08786R08 states in part: The Permittee is required to NOTIFY the Regional Supervisor, DAQ, in WRITING, of the actual date of initial start-up of an affected facility,postmarked within 15 days after such date Specific Condition and Limitation No. 9 of the permit states in part: As required by 15A NCAC 2D .0605, the Permittee shall maintain on-site an equipment list and a plant (or flow) diagram of all equipment covered under this permit. Please respond in writing to the Asheville Regional Office by no later than April 8, 2021. Your response should outline the steps that you plan to take or have taken to assure compliance with the air permit requirements. It should be noted that the violations cited in this letter and any additional documented violations could result in the initiation of an enforcement action by this office in accordance with North Carolina General Statute 143-215.114A, which provides for the assessment of civil penalties If you have any questions with reference to this matter, please do not hesitate to contact Mr. Steve Ensley, or me at(828)296-4500.
