Dear Ms. Bridgers,
Your current air permit, identified above, includes at least one stipulation requiring that a report
be submitted to this Office no later than 1 March every year: condition A.9, 15A NCAC 02D .0803
"Exclusionary Rule Requirements." The report was received in our office on 12 March 2021. Once the
report is reviewed, a compliance determination, based upon the content of the report(s), shall be made.
This letter is to officially inform you that by failing to submit the required report by the due date you
violated your air permit and 15A NCAC 02D .0803 "Exclusionary Rule Requirements."
We are concerned with what appears to be a pattern of non-compliance with A.9, 15A NCAC
02D .0803 `Exclusionary Rule Requirements." The required annual report has been late each year for the
past four years,to include this year. Notice of Deficiency letters for late reporting were sent in 2018 and
2019. A Notice of Violation for late reporting was sent in 2020.
As stated in the subject above, this letter represents a Notice of Violation for the cited violation.
This violation, and any future violation of an air quality regulation, is subject to the assessment of
civil penalties according to North Carolina General Statute 143-215.114A.
Additionally, the Division strongly recommends that you carefully examine your current permit.
