BOX 718 Wadesboro,NC 28170 SUBJECT: Notice of Continuing Violation/Notice of Recommendation for Enforcement: GS 143-215.108A - Operating Without a Permit Valley Proteins, Inc. - Wadesboro Division Wadesboro, Anson County,North Carolina Dear Mr. Thomas: The Division of Air Quality(DAQ) Fayetteville Regional Office (FRO) issued your facility, Valley Proteins, Inc. -Wadesboro Division, a Notice of Violation (NOV), dated 4 June 2020, and a Notice of Continuing Violation (NOCV), dated 7 October 2020, for violating North Carolina General Statute (NCGS) 143-215.108A. The cited violation was for the operation of Crossflow Scrubber, C-8, to control non-condensables from emission sources for which this facility was not, and still is not, permitted. In order to resolve the violation, the FRO DAQ requested your company submit a permit modification application for the new control scenario. Despite the fact that due dates for the application submittal were established in both the NOV and NOCV, your application has not been received as of the date of this letter. Therefore, by failing to obtain an air permit to allow the above-referenced control device operation,you are in continuing violation of GS 143-215.108A. As stated in the "subject' above, this letter represents not only a Notice of Continuing Violation for the above-cited violation but puts you on notice that this office is preparing an enforcement report addressing the violation. The above violation and any future violation of an air quality regulation are subject to the assessment of civil penalties per North Carolina General Statute 143-215.114A. This General Statute provides that civil penalties of not more than twenty-five thousand dollars ($25,000) may be assessed against any person who violates any classification, standard, or limitation established pursuant to General Statute 143-215.107, "Air Quality Standards and Classifications." In addition, each day of continuing violation after written notification from the Division of Air Quality may be considered a separate offense. After the above date this office will submit the enforcement report to the Director of the Division of Air Quality, including recommendations for the assessment of appropriate civil penalties.
