Box 718 Wadesboro,NC 28170 Subject: Notice of Continuing Violation: GS 143-215.108A- Operating Without a Permit Valley Proteins, Inc. - Wadesboro Division Facility ID No. 0400034 Permit Number: 06467T20 Anson County, Wadesboro,NC Fee Class: Title V Dear Mr. Hanks: On June 4, 2020, the Division of Air Quality (DAQ) Fayetteville Regional Office (FRO) issued your facility, Valley Proteins, Inc. - Wadesboro Division, a Notice of Violation (NOV) for violating North Carolina General Statute (NCGS) 143-215.108A. The cited violation was for the operation of Crossflow Scrubber, C-8,to control non-condensables from emission sources for which this facility was, and still is not, currently permitted. The NOV requested that your company submit a permit modification application for the new control scenario no later than July 6, 2020. This office received your company's written response to the NOV, dated June 22, 2020, stating that you anticipated submitting the requested permit application on or before August 15, 2020. On August 31, 2020, Jeffrey Cole, of this office, contacted you regarding the status of your permit application, as it had not been received. You responded in an email dated September 3, 2020, stating that your company was in the process of getting the permit application together and would submit it soon. As of the date of this letter, we have not received your permit application. As stated in the "subject" above, this letter represents a Notice of Continuing Violation for the above-cited violation. Be advised that this violation and any future violation of an air quality regulation is subject to the assessment of civil penalties per North Carolina General Statute 143- 215.114A. In addition, each day of continuing violation after written notification from the Division of Air Quality shall be considered a separate offense.
