Dear Mr. Poteat,
On 21 May 2021 Jeffrey Cole, of the NC Division of Air Quality, Fayetteville Regional
Office (DAQ FRO) visited your facility and observed what appeared to be excessive visible
emissions from the Rock:and Sand Bucket Conveyor Operation(ES ID No. ES 3) This source
is permitted as being controlled by Bagf lter(CIS III No. BH 1 A). General Condition B.6 in
your air permit, states that the facility shall be properly operated and maintained at all times
in a manner that will effect an overall reduction in air pollution." Proper operation of this
controlled source should result in no visible emissions, due to the high particulate matter control
efficiency of the bagfilter. The visible emissions observed from this controlled source indicate
that the source is not being operated and maintained as designed and permitted and,therefore, is
in violation of the requirements of General Condition B. ,
e advised that this same source (ES03) was cited in violation for excessive visible
emissions in April 2017. This office is concerned with what appears to be 'a pattern of this
source not being properly operated and maintained at all times in a�manner that will effect an
overall reduction in air pollution.
.As stated in the"subject" above,this letter represents a Notice of Violation for the above-
cited violation. This violation and any future violation of an air quality regulation is subject to
the assessment of civil penalties per North Carolina General Statute 143-215.114A. In addition,
each day of continuing violation after written notification from the Division of Air Quality shall
be considered a separate offense.

Please submit a written response, e no later than 27 July 2021,, documenting the
corrective actions this facility has taken or plans to take to return to compliance,the date by
which you will be in compliance, and the steps your facility has taken or plans to take to ensure
future compliance with this requirement.
e appreciate your immediate attention to these environmental concerns. Additionally,
the Division strongly recommends that you carefully examine your current per-nit stipulations.
