RE: Notice of Violation-Notification & Recordkeeping Requirements

Dear Mr. Davey:
In response to the Notice of Violation dated March 19, 2021
After investigation, Riverbend Construction Services LLC a subcontractor for Harrison
Construction operating at Harrisons Cherokee County Quarry in Murphy NC experienced a
breakdown of a mobile screening unit then elected to rent a replacement mobile screening unit until
the original unit could be repaired. Harrison Construction was unaware and was not notified by
Riverbend Construction Services LL.0 of this change. I learned of the change during the February 25,
2021 inspection with Mr. Steve Ensley.
As a result of this violation Harrison management met with Riverbend Construction Services
LLC. Management expressing Harrisons displeasure with the lack of communication and notification
of the change. Harrisons management expressed to Riverbend management that this is
unacceptable under any circumstance.
A start date was determined and provided to your office, an updated plant diagram and
equipment list was provided to Mr. Steve Ensley and NSPS VE testing was tentatively scheduled for
April 14, 2021, protocol was sent for DAQ's approval. I was notified Wednesday April 7, 2021 that
Friday April 9, 2021 the mobile screening unit in question will be taken out of service and returned to
the rental company early in the weelk of April 12, 2021.
In conclusion the mobile screening unit will be removed for our site the week of April 12, 2021
subject to the trucking company transport permit date assigned provided by NCDOT. I
