HomeMy WebLinkAboutAQ_F_0200089_20220325_CMPL_NRE s SfAZC 4 ROY COOPER i' A Governor ELIZABETH S.BISER APR"QUA ` Secretary MICHAEL ABRACZINSKAS NORTH CARouNA Director Environmental Quality March 25, 2022 CERTIFIED MAIL 7018 0360 0002 2099 3677 RETURN RECEIPT REQUESTED Mr. Clyde Goble President Royale Comfort Seating, Inc. —Plant No. 1 PO Box 235 Taylorsville,NC 28681 Subject: Notice of Violation and Recommendation for Enforcement Title V Annual Compliance Certification Requirements Royale Comfort Seating Inc.—Plant No. 1 Taylorsville,North Carolina Alexander County 03/0200089—Title V Air Permit No. 08939T04 Dear Mr. Goble: General Condition P of Air Permit No. 08939T04, issued to Royale Comfort Seating, Inc. —Plant No. 1 in Taylorsville, Alexander County,North Carolina on July 10, 2018, states in part: The Permittee shall submit to the DAQ and the EPA (Air and EPCRA Enforcement Branch, EPA, Region 4, 61 Forsyth Street SW, Atlanta, GA 30303)postmarked on or before March 1 a compliance certification (for the preceding calendar year) by a responsible official with all federally-enforceable terms and conditions in the permit, including emissions limitations, standards, or workpractices. It shall be the responsibility of the current owner to submit a compliance certification for the entire year regardless of who owned the facility during the year. The compliance certification shall comply with additional requirements as may be specified under Sections 114(a)(3)or 504(b) of the Federal Clean Air Act. The compliance certification shall Specify.- the identification of each term or condition of the permit that is the basis of the certification; 2. the compliance status (with the terms and conditions of the permit for the period covered by the certification); 3. whether compliance was continuous or intermittent; and 4. the method(s) used for determining the compliance status of the source during the certification period." On March 2, 2022,this office received an annual compliance certification for Royale Comfort Seating, Inc. —Plant No. 1. Although received by the required date,the certification did not meet all the requirements under General Condition P, as described above. Specifically,Royale Comfort Seating,Inc.—Plant No. I failed to identify each condition of the permit that is the basis of the certification and the compliance status of each permit condition. Therefore,this Notice of Violation is issued to Royale Comfort Seating Inc.—Plant No. 1 for failure to comply with the requirements for annual compliance certification listed in Air Permit No. 08939T04, General Condition P. Please submit a written response to this office as quickly as possible, but no later than ten days following receipt of this notice. Your response should include the revised annual compliance certification report and describe any corrective actions that have been taken by the company to assure the submittal of the required report in a timely manner in the future. Your explanation will be reviewed and if an enforcement action is still deemed appropriate,your explanation will be forwarded to the director with the enforcement package for consideration. The revised annual compliance certification should also be submitted to the EPA(Air and EPCRA Enforcement Branch,EPA,Region 4,61 Forsyth Street SW,Atlanta, GA 30303). For your convenience,the DAQ has developed forms for the annual compliance certification, which are enclosed with this letter. The forms are also available on the DAQ web site (https://deq.ne.gov/airannualcompliance). Examples on how to complete the enclosed forms are included in the instructions for the forms. You may opt to use the enclosed forms or you can supply the required information in your own format. If you choose to use your own format, please keep in mind that the format must meet the requirements of the annual compliance certification, including 1),the identification of each term or condition of the permit, 2)the compliance status, 3)whether compliance was continuous or intermittent, and 4)the method(s) used for determining the compliance status of the source. The violation cited in this letter is considered a deviation of your Title V permit and must be reported on your annual compliance certification for calendar year 2022, which is due by March 1, 2023. Failure to report the deviation of your TV permit on next year's annual compliance certification may result in the issuance of a Notice of Violation. It should be noted that the violation cited in this letter or any additional documented violations could result in the initiation of an enforcement action by this office in accordance with North Carolina General Statute 143- 215.114A, which provides for the assessment of civil penalties..
