Dear Mr. Byrum:
15A NCAC 02D.0542 requires Albemarle Cotton Growers to submit an annual report containing
the name and location of the cotton gin and the number of bales produced the previous year, signed by the
responsible official,by March 1 of each year. As of the date of this notice,this office has not received
the required annual report. Please submit the report to the Division of Air Quality by March 28,
2022.
Our records indicate that your facility was issued a Notice of Deficiency on March 23, 2021 and
April 4, 2019 for late submittals of the required report. This letter is intended to formally notify you
that your facility is in violation of 15A NCAC 02D.0542.It should be noted that the violation cited in
this letter and any additional documented violations of any air quality regulation will be subject to the
assessment of civil penalties per North Carolina General Statute 143-215.114A.
To assure that the report is received by the required deadline,this office suggests the submittal of
an electronic copy, followed by a hard copy,to meet the compliance deadline. I appreciate your help in
keeping the air in eastern North Carolina as clean as possible. If you have any questions or concerns
