Dear Mr. Araujo:
This office recently received an EPA complaint from a concerned citizen regarding
possible open burning at property you own located at 254 Jefferson Court NE< Concord,
' Cabarrus County. The complainant indicated that the current resident may be buming garbage,
trash, or other non-vegetative materials.
Previous inquiries from citizens indicate some confusion about what buming is legal.
Since 1971, North Carolina Air Quality rules have prohibited the open buming of most materials.
Only tree leaves, branches and other plant growth generated on an individual's property can be
bumed on the same property under certain conditions. Buming of non-vegetative materials is a
violation of North Carolina Administrative Code Title 15A 2D .1903(b)(1)(C), "Open Buming
Without an Air Quality Permit" which prohibits buming of "non-vegetative materials, such as
household garbage, lumber, or any other synthetic materials". Please find enclosed a copy of our
open buming brochure.
The purpose of this letter is to advise you of the state's open buming mles. If a resident at
property you own is disposing of garbage or trash by open buming, you should have them cease
this practice in accordance with the requirements of the open buming mle.
