HomeMy WebLinkAboutAQ_CC_Cabarrus_20220606_Tamara-Tucker_OB_NOV June 6, 2022 CERTIFIED MAIL RETURN RECEIPT REQUESTED 0715 1520 0002 6985 0566 Ms. Tamara Tucker 4240 Vincent Street Kannapolis NC 28081 Subject: Notice of Violation 15A NCAC 2D .1900, "Open Burning" Open Burning of Synthetic Materials 4240 Vincent Street Kannapolis, North Carolina Cabarrus County Dear Ms. Tucker: Representatives from the Cabarrus Fire Marshal’s office observed the open burning of synthetic materials conducted at 4240 Vincent Street, Kannapolis, Cabarrus County, North Carolina on May 24, 2022. The materials being open burned consisted of, but were not limited to: a mattress, clothes and other household items. Burning of non-vegetative materials is a violation of North Carolina Administrative Code Title 15A 2D .1903(b)(1)(C), "Open Burning Without an Air Quality Permit" which prohibits burning of “non-vegetative materials, such as household garbage, lumber, or any other synthetic materials”. You were contacted on May 24, 2022 by representatives from the Kannapolis Fire Department and representatives from the Cabarrus County Fire Marshal’s office with reference to the above violation. You were also contacted on May 31, 2022 by Mr. Joe Foutz of this office regarding the North Carolina open burning rules and the above violation. Therefore, this Notice of Violation is hereby issued to you for violation of the above referenced state of North Carolina open burning rule. It is requested that a written response to this Notice of Violation be submitted to this office as quickly as possible, but no later than ten days following receipt of this notice. The response should describe any corrective actions that you have taken or plan to take to assure compliance with the above rule at all times. It should be noted that the violation cited in this letter or any additional documented violations could result in the initiation of an enforcement action by this office in accordance with North Carolina General Statute 143-215.114A, which provides for the assessment of civil penalties.
