Dear Mr.Ashley:
Air Permit No. 028151114 was issued to Mitchell Gold Company,Hiddenite,Alexander County,North
Carolina on September 24,2014,with an effective date of September 24,20.14. Specific Condition and Limitation
No.A.8. of the referenced permit states in part:
"NSPS Reporting Requirements -In addition to any other-notification requirements to the
Environmental Protection Agency(EPA),the Permittee is required to NOTIFY the Regional .
Supervisor,DAQ,in WRITING,of the following:
i. The sulfur content of the distillate oil combusted in an affected source shall not exceed 0.5
percent by weight.Within 30 days after each six-month period of the calendar year(by January
30 for the previous six-month period between July and December and by July 30 for the
previous six-month period between January and June),the Permittee must submit in writing to .
the Regional Supervisor,DAQ,the sulfur content of the distillate oil combusted in an affected
source. If fuel supplier certification is used to demonstrate compliance, fuel supplier
certification shall include the following information:
A. The name of the oil supplier;
B. A statement from the oil supplier that the oil complies with the specification under the
definition of distillate oil in 40 CFR-60.41(c); and
C. A certified statement signed by the owner or operator of an affected source that the records
of fuel supplier certification submitted represent all of the fuel combusted during the
reporting period,"

--Furthermore, Specific Limitation and Condition Nos.A.11. of the referenced permit states in part:
"The Permittee shall comply with all requirements of 15A NCAC 2D .1111 "Maximum Achievable
Control Technology" and 40 CFR Part-63; Subpart JJ"National Emission Standards for Wood. .
Furniture Manufacturing Operations." [40 CFR 63.800]
Reporting Requirements-The Permittee shall submit the compliance status report to the Regional .
Supervisor by in accordance with 40 CFR 63.804(f)(8)and 40 CFR 63.807(b).The.Permittee shall
submit semi-annual reports to the Regional Supervisor in accordance with 40 CFR 63.804(g)(8)
and 40 CFR 63.807(c).The Permittee shall follow the reporting requirements in 40 CFR 63.807(e)
as required and 40 CFR 63.807(a)following the applicability criteria in 40 CFR 63.800(d).7:..
The reports due on'July 30,2022 have not yet been received by this office. Therefore,this Notice of
Violation is issued to Mitchell Gold Company for failure to submit the required reports within the required
timeframe in violation of Air Permit No.02815R14 Specific Condition and Limitation Nos.A.8. and A.11.
It is requested that a written response to this Notice.of Violation be subrmitted to this office as quickly
-_ as possible,but no later than ten days following receipt of this notice. The response should include the
reference reports and describe any corrective actions thathave been taken by the company to assure the submittal of
the required reports in a timely manner in the future.
It should be noted that the violations.cited in this letter,or any`additional documented violations could
result in the initiation of an enforcement action by this office in accordance with North Carolina General Statute
143-215.114A,which provides for the assessment of civil penalties.
