Subject: Response to Notice of Violation-Annual Compliance Certification Late Submittal
Title V Report -Johnston County MSW Landfill

Dear Ms. Hartsfield:
This letter serves as response to the notice of violation (NOV) for late submittal of the Title V Annual
Compliance Certification for the Johnston County Municipal Solid Waste (MSW) Landfill located in
Smithfield, NC. As required in General Condition P in Section 3 of Air Permit Nos. 08844T07 and
08844T08, the Title V Annual Compliance Certification (ACC) Statement for reporting year 2020 was
due March 1, 2021. Regrettably, it was brought to our attention by NC DEQ that the report was not
submitted by the deadline. In order to ensure timely submittal going forward, Johnston County will
submit all future ACC reports early, with the semiannual summary report required in condition 3.g of
Permit No. 08844T09, prior to the summary report deadline of January 30, 2022 for the preceding six.-
month period, from July 1 to December 31, 2021. Additionally, the first summary report will be
submitted prior to July 30, 2021 for the six-month period from January 1, 2021 to June 30, 2021. This
NOV will be noted in both reports as an exceedance of permit No. 08844T08 condition 3.P.
