Dear Ms. Hughes:
Your air permit application (0900009.22B) for Chemours Company -Fayetteville Works, located
in Bladen County,North Carolina received by this division on November 1, 2022 has been deemed
incomplete. Your air permit application request must include the following items(s):
Local zoning and subdivision ordinances consistency determination:
Your application did not contain the complete request for consistency determination. Your
application must include a copy of your written request for a "determination of consistency" with
local government ordinances bearing the date of receipt entered by the clerk of each local
government having jurisdiction. The following is a detailed explanation of the determination of
consistency requirements, and includes a description of documentation that must be submitted with
your application.

a. The permit applicant shall submit a signed statement listing any and all local governments
having jurisdiction over any part of the land on which the facility and its appurtenances are
to be located.
b. The applicant is required to send a zoning consistency request determination to each and
every local government entity identified by the applicant as stated above.
c. The zoning consistency request determination from the applicant to the local government
shall include a copy of the draft permit application.
d. The zoning consistency request must be delivered to the clerk of the local government
personally or by certified mail. Personal delivery should be evidenced by a transmittal
letter from the facility stamped received by the local government, dated, and signed by
the official designated by the government to make such a determination. The stamped
received transmittal letter must be included in the permit application submitted to the
Division.
e. The required zoning consistency determination in response to the request by the applicant
must be signed by the official designated by the local government to make such a
determination. If the local government states that the facility is inconsistent with a zoning
or subdivision ordinance, a copy of such a determination shall be submitted to the applicant.
Signature of An Authorized Official:
The signature on the application does not qualify as the signature of an authorized official as
defined by 15A NCAC 2Q.03040). Permit applications submitted pursuant to this Rule shall be
signed as follows:
a. for corporations, by a principal executive officer of at least the level of vice-president, or
his duly authorized representative, if such representative is responsible for overall
operation of the facility from which the emissions described in the permit application
form originates;
b. for partnership or limited partnership,by a general manager;
c. for a sole proprietorship, by the proprietor; or
d. for municipal, state, federal, or other public entity,by a principal executive officer, or
other duly authorized employee.
PE Seal Requirement:
The technical portions of your application was not sealed by a North Carolina registered
professional engineer(PE) as required by 15A NCAC 2Q .0112. You are required to re-submit
the technical portions of your application bearing the seal of a North Carolina PE.

In summary, this application did not contain all the required elements as indicated above
and has not been accepted for processing. This information must be submitted and contain the
above requested information. The requested information must be submitted to our Office within
thirty(30) days or the application may be terminated.
REMINDER: DEQ now provides the option for application fees to be paid online with a debit
card, credit card or eCheck. If you did not include a check with your application package for the
full amount due, you may make payment through the DEQ ePayment website. Please email
Connie Horne at Connie.Horne@ncdenr.gov with your request to make an ePayment and an email
will be sent with details on how to make your payment. If you requested the ePayment option on
Form A of your submitted application form, please refer to the email you should have already
received.
