HOLMAN Air Quality Director ENVIRONMENTAL QUALITY January 24, 2017 CERTIFIED MAIL 7013 2630 0002 1133 5030 RETURN RECEIPT REQUESTED Mr. David Groves, Plant Manager Capital Power Corporation North Carolina- Southport Plant 1281 Powerhouse Dr. SE Southport, North Carolina 28461 SUBJECT: Notice of Violation/Notice of Recommendation for Enforcement 15A NCAC 2D .0530 "Prevention of Significant Deterioration" (PSD) 40 CFR 51.166 "Prevention of Significant Deterioration of Air Quality" CO and PM Emissions—Boilers, ID No. ES-1-IA, 1B, I & ES2-IA, 1B, I Capital Power Corporation North Carolina - Southport Plant Southport, Brunswick County, North Carolina Air Permit No. 05884T20, Facility ID: 1000067, Fee Class: Title V Dear Mr. Groves: On March 02, 2016, the Division of Air Quality received a report from Capital Power Corporation North Carolina- Southport Plant(CPI—Southport) summarizing Projected vs.Actual Emissions for CO, S02, NOx, PM, PM10, and VOC for boilers, ID No. ES-1-IA, 1B, 1C & ES2- 1A, 1B, 1C per 05884T20 permit condition 2.1 —A.5.d. This report was submitted as a result of the 2008 NOx/SO2 Boiler Control Retrofit and Increased Wood/Biomass Firing Project. In that report, the CO, S02 and PM actual emissions were significantly higher than projected emissions contained in the original permit application, 1000067.08B. This resulted in DAQ reviewing the calculations contained in the original application and utilized by the facility to justify the avoidance of submitting a PSD application. As a result of this review, DAQ has determined that your facility's emissions are greater than the projected actual emissions originally submitted. The DAQ found that the PSD threshold levels for both PM and CO were exceeded and a PSD application should have been submitted for the 2008 project. This letter is intended to formally notify you that Capital Power Corporation North Carolina- Southport Plant is in violation of 15A NCAC 2D .0530 and 40 CFR 50.166 for failure to submit a Prevention of Significant Deterioration permit application for the Boiler NOx/SO2 Control Retrofit and Increased Wood/Biomass Firing Project. North Carolina General Statute 143- 215.114A provides that a civil penalty of not more than $25,000.00 per violation may be assessed against a company who violates or fails to act in accordance with the terms, conditions, or requirements of a permit required by North Carolina General Statute 143- 215.108. If you have an explanation for the violation that you wish to present, or if you believe the findings stated in this letter are incorrect, please reply within fifteen (15) days after receipt of this letter. Your documentation will be forwarded with the enforcement package to the Director for her review. A PSD application for the 2008 NOx/SO2 Boiler Control Retrofit and Increased Wood/Biomass Firing Project must be submitted to the Division of Air Quality no later than thirty (30) days following receipt of this notice. Please include all carbon monoxide monitoring data since CO CEMs monitoring was initiated. Also include summaries of all PM stack test data from relevant stack testing from the submittal date of the 2008 application to year to date.
