Additionally, any emissions activities determined from your air permit application as meeting the exemption requirements contained in 15A NCAC 2Q .0102 have been listed for information purposes as an "ATTACHMENT" to the enclosed air permit. Please note the records retention requirements are contained in General Condition 2 of the General Conditions and Limitations. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to request a formal adjudicatory hearing within 30 days following receipt of this permit, identifying the specific issues to be contested. Such a request will stay the effectiveness of the entire permit. This hearing request must be in the form of a written petition, conforming to G.S. 150B-23 of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh,NC 27699-6714. The form for requesting a formal adjudicatory hearing may be obtained upon request from the Office of Administrative Hearings. Unless a request for a hearing is made pursuant to G.S. 15013-23,this air permit shall be final and binding. You may request modification of your air permit through informal means pursuant to G.S. 15013-22. This request must be submitted in writing to the Director and must identify the specific provisions or issues for which the modification is sought. Please note that the permit will become final and binding regardless of a request for informal modification unless a request for a hearing is also made under G.S. 15013-23. Failure to do so is a violation of G.S. 143-215.108 and may subject the Permittee to civil or criminal penalties as described in G.S. 143-215.114A and 143- 215.114B. This permit shall be effective from December 01, 2016 until November 30,2024, is nontransferable to future owners and operators, and shall be subject to the conditions and limitations as specified therein. This permit is subject to the following specified conditions and limitations including any TESTING, REPORTING, OR MONITORING REQUIREMENTS: A. SPECIFIC CONDITIONS AND LIMITATIONS 1. Any air emission sources or control devices authorized to construct and operate above must be operated and maintained in accordance with the provisions contained herein. The Permittee shall comply with applicable Environmental Management Commission Regulations, including Title 15A North Carolina Administrative Code (NCAC), Subchapter 2D .0202, 2D .0515, 2D .0516, 2D .0521, 2D .0524 (40 CFR 60, Subpart JJJJ), 2D .0535, 2D .0540, 2D .0605, 2D .0611, 2D .1100, 2D .1111 (40 CFR 63, Subpart ZZZZ), 2D .1806, 2Q .0315,2Q .0317 (Avoidance),2Q .0711 and NC General Statutes NCGS 62-133.8(g). 2. PERMIT RENEWAL AND EMISSION INVENTORY REQUIREMENT -The Permittee, at least 90 days prior to the expiration date of this permit, shall request permit renewal by letter in accordance with 15A NCAC 2Q .0304(d) and (0. Pursuant to 15A NCAC 2Q .0203(i), no permit application fee is required for renewal of an existing air permit(without a modification request). The renewal request(with AA application form) should be submitted to the Regional Supervisor, DAQ. Also, at least 90 days prior to the expiration date of this permit, the Permittee shall submit the air pollution emission inventory report (with Certification Sheet) in accordance with 15A NCAC 2D .0202,pursuant to N.C. General Statute 143 215.65. The report shall be submitted to the Regional Supervisor, DAQ and shall document air pollutants emitted for the 2023 calendar year. 3. PARTICULATE CONTROL REQUIREMENT-As required by 15A NCAC 2D .0515 "Particulates from Miscellaneous Industrial Processes," particulate matter emissions from the emission sources shall not exceed allowable emission rates. The allowable emission rates are, as defined in 15A NCAC 2D .0515, a function of the process weight rate and shall be determined by the following equation(s), where P is the process throughput rate in tons per hour(tons/hr)and E is the allowable emission rate in pounds per hour(lbs/hr). E=4.10 * (P) 0 67 for P <=30 tons/hr, or E = 55 * (P) 0 '- 40 for P >30 tons/hr 4. SULFUR DIOXIDE CONTROL REQUIREMENT - As required by 15A NCAC 2D .0516 "Sulfur Dioxide Emissions from Combustion Sources," sulfur dioxide emissions from the combustion sources shall not exceed 2.3 pounds per million Btu heat input. VISIBLE EMISSIONS CONTROL REQUIREMENT - As required by 15A NCAC 2D .0521 "Control of Visible Emissions," visible emissions from the emission sources, manufactured after July 1, 1971, shall not be more than 20 percent opacity when averaged over a six-minute period, except that six-minute periods averaging not more than 87 percent opacity may occur not more than once in any hour nor more than four times in any 24-hour period. However, sources which must comply with 15A NCAC 2D .0524 "New Source Performance Standards" or .I 110 "National Emission Standards for Hazardous Air Pollutants" must comply with applicable visible emissions requirements contained therein. 6. 15A NCAC 2D .0524 "NEW SOURCE PERFORMANCE STANDARDS" - For the following equipment, the Permittee shall comply with all applicable provisions, including the notification, testing, reporting, recordkeeping, and monitoring requirements contained in Environmental Management Commission Standard 15A NCAC 2D .0524 "New Source Performance Standards" (NSPS) as promulgated in 40 CFR Part 60, Subpart indicated below, and including Subpart A "General Provisions. _...._........... _........ . ......... ... ... -------------- P.......... NUNN- IN i Subpart JJJJ Four(4) 2,079 hp Biogas-fired Spark Ignition Internal Combustion Engines, Standards of utilizing low-sulfur, conditioned digester gas, in combination with one (1) ' Performance for 1,550 kW electrical generator each Stationary Spark (ID Nos. ES-ENG1, ES-ENG2, ES-ENG3 and ES-ENG4) Ignition Combustion Engines (SI ICE) a. Compliance Requirements - As required by 15A NCAC 2D .0524, the following compliance requirements shall apply: i. The Permittee shall operate and maintain stationary SI ICE that achieve the a emission standards as required in 40 CFR 60.4233 over the entire life of the engine. [60.4234] ii. Owners and operators of stationary SI ICE who conduct performance tests shall follow the procedures in 40 CFR 60.4244. [60.4244] iii. For the stationary SI ICE that must comply with the emission standards specified in 40 CFR 60.4233(d) or(e),the Permittee shall demonstrate compliance according to one of the methods specified in paragraphs A and B of this section. [60.4243(b)] a A. Purchasing an engine certified according to procedures specified in I this subpart, for the same model year and demonstrating compliance according to one of the methods specified in 40 CFR 60.4243(a) [60.4243(b)(1)]; or sB. Purchasing a non-certified engine and demonstrating compliance with the emission standards specified in 40 CFR 60.4233(d) or(e) and according to the requirements specified in 40 CFR 60.4244, as applicable, and according to the following: [60.4243(b)(2)] Permit No. 10515R00 Page 4 I. The following emission standards shall apply: 1. NOx: 2.0 g/hp-hr or 150 ppmvd at 15% 02; 2. CO: 5.0 g/hp-hr or 610 ppmvd at 15% 02; 3. VOC: 1.0 g/hp-hr or 80 ppmvd at 15% 02; 4. Owners and operators of stationary non-certified SI engines may choose to comply with the emission standards in units of either g/hp-hr or ppmvd at 15% 02. IL For a stationary SI ICE that is greater than 500 HP, the Permittee shall keep a maintenance plan and records of conducted maintenance and shall,to the extent practicable, maintain and operate the engine in a manner consistent with good air pollution control practice for minimizing emissions. In addition,the Permittee shall conduct an initial performance test and conduct subsequent performance testing every 8,760 hours or 3 years, whichever comes first,thereafter to demonstrate compliance. [60.4243(b)(2)(ii)] iv. It is expected that air-to-fuel ratio (AFR) controllers will be used with the operation of three-way catalysts/non-selective catalytic reduction. The AFR controller shall be maintained and operated appropriately in order to ensure proper operation of the engine and control device to minimize emissions at all times. [60.4243(g)] b. Recordkeeping Requirements - As required by 15A NCAC 2D .0524,the following recordkeeping requirements shall apply: i. The Permittee shall keep records as follows: [60.4245] i A. All notifications submitted to comply with this subpart and all documentation supporting any notification; [60.4245(a)(1)] B. Maintenance conducted on the engine; [60.4245(a)(2)] 3 3 a C. If the stationary SI ICE is a certified engine, documentation from the. manufacturer that the engine is certified to meet the emission standards and information as required in 40 CFR parts 90, 1048, 1054, and 1060, as applicable [60.4245(a)(3)]; and D. If the stationary SI ICE is not a certified engine or is a certified engine operating in a non-certified manner and subject to 40 CFR 60.4243(a)(2), documentation that the engine meets the emission standards. [60.4245(a)(4)] 9 i Permit No. 10515R00 Page 5 ii. A copy of the maintenance plan, if required, and records of conducted maintenance. [60.4243(a)(1)] iii. Copies of any performance testing required under this Subpart. [60.4245(d)] iv. All records required under this section shall be maintained for a period of two years following the date of such record. All records shall be kept on-site and made available to DAQ personnel upon request. The Permittee shall be deemed in noncompliance with 15A NCAC 2D .0524 if recordkeeping requirements are not maintained. [40 CFR 60.7(o] c. Reporting Requirements -As required by 15A NCAC 2D .0524, the following reporting requirements shall apply: i. For SI ICE subject to performance testing as required, and conducted according to the requirements of 40 CFR 60.4244, the Permittee shall submit a copy of each performance test within 60 days after the test has been completed. [60.4243(a)(2), (b)(2), (e), and(f)] i ii. For stationary SI ICE greater than or equal to 500 HP that have not been certified by an engine manufacturer to meet the emission standards in 40 CFR 60.4231,the Permittee shall submit an initial notification as required in 40 CFR 60.7(a)(1). The notification shall include the information in paragraphs (A)through(E) of this section. [60.4245(c)] A. Name and address of the owner or operator; [60.4245(c)(1)] B. The address of the affected source; [60.4245(c)(2)] I C. Engine information including make, model, engine family, serial number, model year, maximum engine power, and engine displacement; [60.4245(c)(3)] i D. Emission control equipment; [60.4245(c)(4)] and E. Fuel used. [60.4245(c)(5)] 7. NOTIFICATION REQUIREMENT - As required by 15A NCAC 2D .0535, the Permittee of a source of excess emissions that last for more than four hours and that results from a malfunction, a breakdown of process or control equipment or any other abnormal conditions, shall: a. Notify the Director or his designee of any such occurrence by 9:00 a.m. Eastern time of the Division's next business day of becoming aware of the occurrence and ' describe: i ° i. the name and location of the facility, f ii. the nature and cause of the malfunction or breakdown, Permit No. 10515R00 Page 6 i iii. the time when the malfunction or breakdown is first observed, iv. the expected duration, and I V. an estimated rate of emissions. b. Notify the Director or his designee immediately when the corrective measures have been accomplished. This reporting requirement does not allow the operation of the facility in excess of Environmental Management Commission Regulations. 8. FUGITIVE DUST CONTROL REQUIREMENT - As required by 15A NCAC 2D .0540 "Particulates from Fugitive Dust Emission Sources," the Permittee shall not cause or allow fugitive dust emissions to cause or contribute to substantive complaints or excess visible emissions beyond the property boundary. If substantive complaints are received or excessive fugitive dust emissions from the facility are observed beyond the property boundaries for six minutes in any one hour(using Reference Method 22 in 40 CFR, Appendix A),the owner or operator may be required to submit a fugitive dust plan as described in 2D .0540(f). "Fugitive dust emissions" means particulate matter that does not pass through a process stack or vent and that is generated within plant property boundaries from activities such as: unloading and loading areas,process areas stockpiles, stock pile working,plant parking lots, and plant roads (including access roads and haul roads). 9. TESTING REQUIREMENT-Under the provisions of North Carolina General Statute 143- 215.108 and in accordance with 15A NCAC 2D .0605,the Permittee shall demonstrate compliance with the emission limit(s)by testing the emission source(s)for the specified pollutant(s) as follows: DAQ Four(4) 2,079 hp Biogas-fired ' 1.45 lb/hr(per engine) Approved 1 Spark Ignition Internal I Method Combustion Engines,utilizing 3 .____. low-sulfur, conditioned digester Establish reduction efficiency gas,in combination with one(1) Formaldehyde 1 for formaldehyde by testing 1,550 kW electrical generator ! formaldehyde emissions at the DAQ inlet and outlet of the catalyst o Approved each (ID Nos. ES-ENG1 ES-ENG2 (ID Nos. CD-SCRCOI, Method ES-ENG3 and ES-ENG4) i SCRCO2, SCRCO2, and SCRCO4) i a. The Permittee shall arrange for air emission testing protocols to be provided to the DAQ prior to testing. Testing protocols are not required to be pre-approved by the DAQ prior to testing. The DAQ shall review testing protocols for pre-approval prior to testing if requested by the Permittee at least 45 days before conducting the test. Permit No. 10515R00 Page 7 b. To afford the Regional Supervisor, DAQ,the opportunity to have an observer present,the Permittee shall PROVIDE the Regional Office, in WRITING, at least 15 days' notice of any required performance test(s). c. The test shall be performed in conjunction with, and the test results submitted with those from, the initial performance test required by New Source Performance Standard Subpart JJJJ. d. This permit may be revoked, with proper notice to the Permittee, or enforcement procedures initiated, if the results of the test(s) indicate that the facility does not meet applicable limitations. e. The source shall be responsible for ensuring, within the limits of practicality, that the equipment or process being tested is operated at or near its maximum normal production rate, or at a lesser rate if specified by the Director or his delegate. f. All associated testing costs are the responsibility of the Permittee. i 10. SCRUBBER REQUIREMENTS -As required by 15A NCAC 2D .0611, emissions shall be controlled as described in the permitted equipment list. j a. Inspection and Maintenance Requirements - To comply with the provisions of this permit and ensure that emissions do not exceed the regulatory limits, the Permittee shall perform periodic inspections and maintenance (I&M) as recommended by the manufacturer. In addition, the Permittee shall perform an annual (for each 12-month period following the initial inspection) internal inspection of each scrubber system. I As a minimum,the I&M program and each annual inspection should include the following: 1 i. inspection of spray nozzles, packing material, chemical feed system (if so equipped), and the cleaning/calibration of all associated instrumentation annually. ii. two weeks following initial start-up and startup following major maintenance of each scrubber, the Permittee shall shut down the system and inspect for nozzle plugging and settling of the packing. a jb. Monitoring Requirements - The Permittee shall ensure the proper performance of each scrubber by monitoring the following operational parameters: i 3 i. For the Venturi Scrubber (ID No. CD-SCRUBI): A. The Permittee shall record the liquid flow rate daily, and maintain a 3- hour block average between 430-530 gal/min; and B. The Permittee shall record the pressure drop across the scrubber daily, tt e e p p y, and maintain a 3-hour block average less than or equal to 1.5" H2O. Permit No. 10515R00 Page 8 ii. For the Packed Bed Scrubber(ID No. CD-SCRUB2): A. The Permittee shall record the pH of the liquid in the scrubber sump daily, and maintain the 3-hour block average between 2-4 utilizing sulfuric acid solution; B. The Permittee shall record the recirculation rate of the scrubber daily, and maintain the 3-hour block average greater than or equal to 3.5 gal/min; and C. The Permittee shall record the pressure drop across the scrubber daily, and maintain a 3-hour block average less than or equal to 1.5" H2O. iii. For the Packed Bed Scrubber(ID No. CD-SCRUB3): A. The Permittee shall record the ORP of the liquid in the scrubber sump daily, and maintain the 3-hour block average between+550 and+650 mV utilizing sodium hydroxide and/or sodium hypochlorite solutions; B. The Permittee shall record the recirculation rate of the scrubber daily, and maintain the 3-hour block average greater than or equal to 3.5 gal/min; and C. The Permittee shall record the pressure drop across the scrubber daily, and maintain a 3-hour block average less than or equal to 1.5" H2O. c. Recordkeeping Requirements - The results of all inspections and any variance from manufacturer's recommendations or from those given in this permit(when applicable) shall be investigated with corrections made and dates of actions recorded in a logbook. Records of all maintenance and monitoring activities shall be recorded in the logbook. The logbook(in written or electronic format) shall be kept on-site and made available to DAQ personnel upon request. 11. SELECTIVE CATALYTIC REDUCTION (SCR), AMMONIA SLIP CATALYST, and OXIDATION CATALYST REQUIREMENTS - As required by 15A NCAC 2D .0611, emissions shall be controlled as described in the permitted equipment list. a. Inspection and Maintenance Requirements = To comply with the provision of this permit and ensure that emissions do not exceed the regulatory limits,the Permittee shall perform periodic inspections and maintenance (I&M) as recommended by the manufacturer. In addition,the Permittee shall perform an annual inspection of the pollution control device. b. Recordkeeping Requirements - The results of all inspections and any variance from manufacturer's recommendations or from those given in this permit(when applicable) shall be investigated with corrections made and dates of actions recorded in a logbook. Records of all maintenance and monitoring activities shall be recorded in the logbook. The logbook(in written or electronic format) shall be kept on-site and made available to DAQ personnel upon request. i Permit No. 10515R00 Page 9 c. Monitoring Requirements i. The Permittee shall ensure proper performance of each catalytic emissions control system by monitoring the following operational parameters: A. The Permittee shall record the injection rate of the urea solution to each catalyst daily, and maintain the 3-hour block average between 0.6-1.5 gal/hr; B. The Permittee shall record the temperature rise across each catalyst daily, and maintain the 3-hour block average between 550-925 degrees Fahrenheit; and C. The Permittee shall record the pressure drop across each catalyst daily, and maintain the 3-hour block average between 5-15" H2O. ii. If different operating parameters than those listed in section"i." above are established during performance testing, the Permittee shall submit an application for an Administrative Permit Amendment within 90 days of completion of the testing. iii. Operating parameters for the catalytic emissions control systems as specified in this permit do not apply during performance tests or emissions tests conducted in an attempt to establish new operating parameters or emission factors. The source shall be responsible for ensuring, within the limits of practicality, that the equipment or process being tested is operated at or near its maximum normal production rate, or at a lesser rate if specified by the Director or his delegate. 12. TOXIC AIR POLLUTANT EMISSIONS LIMITATION AND REPORTING REQUIREMENT - Pursuant to 15A NCAC 2D .1100 "Control of Toxic Air Pollutants," and in accordance with the approved application for an air toxic compliance demonstration, the following permit limits shall not be exceeded: z 5.2 TPH Belt Dryer, heated indirectly utilizing waste heat from engine exhaust or directly by a low-NOx Hydrogen sulfide natural gas-fired burner 16.28 lb/day E (8.8 mBtu/hr maximum heat input) (7783-06-4) m (ES-DRY1) a. Restrictions - To ensure compliance with the above limits,the following restrictions shall apply: i. Emissions from the Belt Dryer (ID No. ES-DRY1) shall be controlled as described in the permitted equipment list; and Permit No. 10515R00 Page 10 ii. The Permittee shall perform inspections and maintenance per the requirements of the 15A NCAC 2D .0611 "Scrubber Requirements" specific condition in this permit. 13. 15A NCAC 2D .1111 "MAXIMUM ACHIEVABLE CONTROL TECHNOLOGY"- For the Four(4)2,079 HP Biogas-fired Spark Ignition Internal Combustion Engine, utilizing low- sulfur, conditioned digester gas,in combination with one.(1) 1,550 kW electrical generator each (ID Nos. ES-ENG1, ES-ENG2,ES-ENG3, and ES-ENG4), classified as new stationary RICE located at an area source of HAP emissions,the Permittee shall comply with all applicable provisions, including the notification,testing, reporting, recordkeeping, and monitoring requirements contained in Environmental Management Commission Standard 15A NCAC 2D .1111, as promulgated in 40 CFR 63, Subpart ZZZZ - "National Emissions Standards for Hazardous Air Pollutants for Stationary Reciprocating Internal Combustion Engines," including Subpart A "General Provisions." a. In accordance with 40 CFR §63.6590(c)(1),this source(s) shall meet the requirements of 40 CFR 63 Subpart ZZZZ and Subpart A by meeting the j requirements of 40 CFR 60 Subpart JJJJ for spark ignition engines.No further requirements apply for such engines under 40 CFR 63 Subpart ZZZZ or Subpart A. `i .14. CONTROL AND PROHIBITION OF ODOROUS EMISSIONS -As required by 15A NCAC 2D .1806 "Control and Prohibition of Odorous Emissions" the Permittee shall not operate the facility without implementing management practices or installing and operating odor control equipment sufficient to prevent odorous emissions from the facility from .i causing or contributing to objectionable odors beyond the facility's boundary. i i 15. Federal and State Rules Applicable to Sources Exempted from Air Permitting Requirements - Your facility is subject to the following federal and state rules: 40 CFR 60 -NSPS - Subpart IIII -- Standards of Performance for Stationary i Compression Ignition Internal Combustion Engines j 40 CFR 63 -NESHAP/MACT-- Subpart ZZZZ --Reciprocating Internal Combustion Engines i which are applicable to some of the emission sources at your facility listed on the. "Insignificant/Exempt Activities" list attached to this permit. The purpose of this permit condition is to inform you of your compliance obligations to these applicable rules as they are enforceable. {i 3 I f i Permit No. 10515R00 Page 11 16. LIMITATION TO AVOID 15A NCAC 2Q .0501 - Pursuant to 15A NCAC 2Q .0315 "Synthetic Minor Facilities," to avoid the applicability of 15A NCAC 2Q .0501 "Purpose of Section and Requirement for a Permit, as requested by the Permittee, facility-wide emissions shall be less than the following: ._ - PMio 100 NOx 100 VOC 100 CO 100 Individual HAPs 10 Total HAPs 25 a. Operations Restrictions - To ensure emissions do not exceed the limitations above, the following restrictions shall.apply: j i. The volume of biogas combusted in the flare (ID No. ES-FLARED shall be j less than 794.8 million cubic feet per consecutive 12-month period. ii. Emissions shall be controlled as described in the permitted equipment list; iii. The Permittee shall perform inspections and maintenance per the ` requirements of the 15A NCAC 2D .0611 "Scrubber Requirements" and "Selective Catalytic Reduction(SCR), Ammonia Slip Catalyst, and Oxidation Catalyst Requirements" specific conditions in this permit. b. Recordkeeping Requirements i. The Permittee shall record monthly and total monthly (for the previous 12 months)the following: A. The volume of biogas combusted in the flare (ID No. ES-FLARED; and E B. The facility-wide PMio,NOx, VOC, CO, and HAP emissions. c. Reporting Requirements - Within 30 days after each calendar year, regardless of the actual emissions, the Permittee shall submit the following: i. emissions and/or operational data listed below. The data should include monthly and 12 month totals for the previous 12-month period. i 3 A. The volume of biogas combusted in the flare (ID No. ES-FLARED; I and i B. The facility-wide PMIo,NOx, VOC, CO, and HAP emissions. i Permit No. 10515R00 Page 12 i 17. LIMITATION TO AVOID 15A NCAC 2D .0530 "PREVENTION OF SIGNIFICANT DETERIORATION" - In accordance with 15A NCAC 2Q .0317,to comply with this permit 1 and avoid the applicability of 15A NCAC 2D .0530 "Prevention of Significant Deterioration," as requested by the Permittee, emissions shall be limited as follows: i I Facility Wide CO m rt 250 Facility Wide �- VOC 250 ................_..._, __.. . _ _W_......._._ a. Operations Restrictions, Recordkeeping Requirements, and Reporting Requirements - By complying with the operations restrictions,recordkeeping requirements, and reporting requirements in.stipulation 15A NCAC 2Q .0315, Limitation to Avoid 15A NCAC 2Q .0501, in a correct and timely manner, the Permittee shall have also complied with the operating restrictions, recordkeeping requirements, and reporting requirements for 15A NCAC 2Q .0317, Limitation to Avoid 15A NCAC 2D .0530. 18. TOXIC AIR POLLUTANT EMISSIONS LIMITATION REQUIREMENT - Pursuant to 15A NCAC 2Q .0711 "Emission Rates Requiring a Permit," for each of the below listed toxic air pollutants (TAPs),the Permittee has made a demonstration that facility-wide actual emissions, where one or more emission release points are obstructed or non-vertically oriented, do not exceed the Toxic Permit Emission Rates (TPERs) listed in 15A NCAC 2Q .0711(a). The facility shall be operated and maintained in such a manner that emissions of any listed TAPs from the facility, including fugitive emissions, will not exceed TPERs listed in 15A NCAC 2Q .0711(a). a. A permit to emit any of the below listed TAPs shall be required for this facility if actual emissions from all sources will become greater than the corresponding TPERs. b. PRIOR to exceeding any of these listed TPERs,the Permittee shall be responsible for obtaining a permit to emit TAPs and for demonstrating compliance with the requirements of 15A NCAC 2D .1100 "Control of Toxic Air Pollutants". North Carolina General Statute [GS §62-133.8(g)] - STATE ENFORCEABLE ONLY - i For the four(4) 2,079 hp biogas-fired, spark ignition, internal combustion engines (ID Nos. ES-ENG1, ES-ENG2, ES-ENG3, and ES-ENG4),the Permittee shall limit emissions as follows for the following pollutants: - Carbon Monoxide (CO) -Nitrogen Oxides (NOx) - Particulate Matter(PMI0/PM2.5) - Sulfur Dioxide (SO2) -Volatile Organic Compounds (VOCs) -Mercury(Hg) a. Best Available Control Technology (BACT): i. In order to comply with the best available control technology (BACT) determination pursuant to GS §62-133.8(g) for Carbon Monoxide: A. Carbon Monoxide emissions shall not exceed the New Source Performance limits per Subpart JJJJ (calculated in ppmvd at 15% 02 or g/hp-hr) B. Carbon Monoxide shall be controlled from the engines using good combustion practices. ii. In order to comply with the best available control technology (BACT) determination pursuant to GS §62-133.8(g) for Nitrogen Oxide: A. Nitrogen Oxide emissions shall not exceed New Source Performance limits per Subpart JJJJ (calculated in ppmvd at 15% 02 or g/hp-hr) B. Nitrogen Oxide shall be controlled from the engines using good combustion practices. iii. In order to comply with the best available control technology (BACT) determination pursuant to GS §62-133.8(g) for PMIo/PM2.5: A. PMI0/PM2.5 shall be controlled from the engines using good combustion practices and the burning of conditioned digester gas in the engines. iv. In order to comply with the best available control technology (BACT) determination pursuant to GS §62-133.8(g) for Sulfur Dioxide: A. Sulfur Dioxide shall be controlled from the engines using good combustion practices and the burning of low-sulfur, conditioned digester gas in the engines. Permit No. 10515R00 Page 15 B. Low-sulfur, conditioned digester gas shall be defined as digester gas which has been passed through a biofilter and an activated carbon filter, and meets the engine manufacturer's specifications. V. In order to comply with the best available control technology (BACT) determination pursuant to GS §62-133.8(g) for Volatile Organic Compounds: A. Volatile Organic Compounds shall be controlled from the engines using good combustion practices and the burning of conditioned digester gas in the engines. vi., In order to comply with the best available control technology (BACT) determination pursuant to GS §62-133.8 (g) for Mercury: A. Mercury shall be controlled from the engines using good combustion practices and the burning of conditioned digester gas in the engines. b. Test results from 40 CFR 60.4244, NSPS Subpart JJJJ, shall be used to demonstrate compliance with the State BACT limits listed above in this Section. L c. The Permittee shall perform inspections and maintenance as recommended by the manufacturer. In addition to the manufacturer's inspection and maintenance recommendations, or if there are no manufacturer's inspection and maintenance recommendations, as a"minimum, the inspection and maintenance requirement shall include the following: i. The Permittee shall perform an annual inspection(for each 12-month period following the initial inspection) to ensure the engines are operating properly. i ii. The results of inspection and maintenance shall be maintained in a logbook (written or electronic format) on-site and made available to an authorized representative upon request. The logbook shall record the following: A. The date and time of each recorded action; B. The results of each inspection; ' C. The results of any maintenance performed on the engines; and D. Any variance from the manufacturer's recommendation, and the corrections made. i 3 j i 7 1 Permit No. 10515R00 Page 16 B. GENERAL CONDITIONS AND LIMITATIONS 1. In accordance with G.S. 143-215.108(c)(1), TWO COPIES OF ALL DOCUMENTS, REPORTS, TEST DATA, MONITORING DATA,NOTIFICATIONS, REQUESTS FOR RENEWAL, AND ANY OTHER INFORMATION REQUIRED BY THIS PERMIT shall be submitted to the: Regional Supervisor North Carolina Division of Air Quality Fayetteville Regional Office Systel Building 225 Green Street, Suite 714 Fayetteville,NC 28301-5094 910-433-3300 For identification purposes, each submittal should include the facility name as listed on the. permit,the facility identification number, and the permit number. 2. RECORDS RETENTION REQUIREMENT - In accordance with 15A NCAC 2D .0605, any records required by the conditions of this permit shall be kept on site and made available to DAQ personnel for inspection upon request. These records shall be maintained in a form suitable and readily available for expeditious inspection and review. These records must be kept on site fora minimum of 2 years, unless another time period is otherwise specified. i 3. ANNUAL FEE PAYMENT- Pursuant to 15A NCAC 2Q .0203(a), the Permittee shall pay the annual permit fee within 30 days of being billed by the DAQ. Failure to pay the fee in a timely manner will cause the DAQ to initiate action to revoke the permit. i 4. EQUIPMENT RELOCATION - In accordance with 15A NCAC 2Q .0301, a new air permit shall be obtained by the Permittee prior to establishing, building, erecting, using, or operating the emission sources or air cleaning equipment at a site or location not specified in this permit. 5. REPORTING REQUIREMENT - In accordance with 15A NCAC 2Q .0309, any of the following that would result in previously unpermitted,new,or increased emissions must be reported to the Regional Supervisor, DAQ: a a. changes in the information submitted in the application regarding facility emissions; ' b. changes that modify equipment or processes of existing permitted facilities; or c. changes in the quantity or quality of materials processed. If appropriate, modifications to the permit may then be made by the DAQ to reflect any necessary changes in the permit conditions. In no case are any new or increased emissions allowed that will cause a violation of the emission limitations specified herein. 1 Permit No. 1 OS 15R00 Page 17 6. In accordance with 15A NCAC 2Q .0309, this permit is subject to revocation or modification by the DAQ upon a determination that information contained in the application or presented in the support thereof is incorrect, conditions under which this permit was granted have changed, or violations of conditions contained in this permit have occurred. In accordance with G.S. 143-215.108(c)(1), the facility shall be properly operated and maintained at all times in a manner that will effect an overall reduction in air pollution. Unless otherwise specified by this permit, no emission source may be operated without the concurrent operation of its associated air cleaning device(s) and appurtenances. 7. In accordance with G.S. 143-215.108(c)(1), this permit is nontransferable by the Permittee. Future owners and operators must obtain a new air permit from the DAQ. 8. In accordance with G.S. 143-215.108(c)(1), this issuance of this permit in no way absolves j the Permittee of liability for any potential civil penalties which may be assessed for 1 violations of State law which have occurred prior to the effective date of this permit. a 9. In accordance with G.S. 143-215.108(c)(1), this permit does not relieve the Permittee of the responsibility of complying with all applicable requirements of any Federal, State, or Local water quality or land quality control authority. 10. In accordance with 15A NCAC 2D .0605, reports on the operation and maintenance of the facility shall be submitted by the Permittee to the Regional Supervisor, DAQ at such intervals and in such form and detail as may be required by the DAQ. Information required in such reports may include, but is not limited to,process weight rates, firing rates, hours of operation, and preventive maintenance schedules. 11. A violation of any term or condition of this permit shall subject the Permittee to enforcement pursuant to G.S. 143-215.114A, 143-215.11413, and 143-215.114C, including assessment of civil and/or criminal penalties. 12. Pursuant to North Carolina General Statute 143-215.3(a)(2),no person shall refuse entry or access to any authorized representative of the DAQ who requests entry or access for purposes of inspection, and who presents appropriate credentials, nor shall any person obstruct, hamper, or interfere with any such representative while in the process of carrying out his official duties. Refusal of entry or access may constitute grounds for permit revocation and assessment of civil penalties. 13. In accordance with G.S. 143-215.108(c)(1),this permit does not relieve the Permittee of the a responsibility of complying with any applicable Federal, State, or Local requirements governing the handling, disposal, or incineration of hazardous, solid, or medical wastes, including the Resource Conservation and Recovery Act(RCRA) administered by the Division of Waste Management. j 14. PERMIT RETENTION REQUIREMENT - In accordance with 15A NCAC 2Q .0110,the Permittee shall retain a current copy of the air permit at the site. The Permittee must make available to personnel of the DAQ, upon request, the current copy of the air permit for the site. e Permit No. 10515R00 Page 18 15. CLEAN AIR ACT SECTION 112(r)REQUIREMENTS -Pursuant to 15A NCAC 2D .2100 "Risk Management Program," if the Permittee is required to develop and register a risk management plan pursuant to Section 112(r) of the Federal Clean Air Act, then the Permittee is required to register this plan with the USEPA in accordance with 40 CFR Part 68. 16. PREVENTION OF ACCIDENTAL RELEASES - GENERAL DUTY- Pursuant to Title I Part A Section 112(r)(1) of the Clean Air Act "Hazardous Air Pollutants-Prevention of Accidental Releases -Purpose and General Duty," although a risk management plan may not be required, if the Permittee produces, processes, handles, or stores any amount of a listed hazardous substance, the Permittee has a general duty to take such steps as are necessary to prevent the accidental release of such substance and to minimize the consequences of any release. This condition is federally-enforceable only. 17. GENERAL EMISSIONS TESTING AND REPORTING REQUIREMENTS - If emissions testing is required by this permit, or the DAQ,or if the Permittee submits emissions testing to the DAQ in support of a permit application or to demonstrate compliance,the Permittee j shall perform such testing in accordance with 15A NCAC 2D .2600 and follow all DAQ procedures including protocol approval, regional notification,report submittal, and test results approval.
