Box 809 Kenansville,NC 28349 SUBJECT: Notice of Deviation: 40 CFR 63 Subpart 6J,Failure to Conduct Energy Assessment Elizabethtown Energy, LLC., Air Permit No. 054551717 Elizabethtown, Bladen County 06/0900043 Fee Class: Title V Dear Mr. Michael, Mr. Jim Moser of this office conducted a compliance inspection of your facility, Elizabethtown Energy, LLC, on 20 March 2014. In the course of the inspection, Mr. Moser learned from the plant manager, Randy Coates, and Mike Wood, EHS Manager, that you would not complete by the following day's deadline the energy assessment required by 40 CFR Part 63 Subpart JJJJJJ and by your permit stipulation A.9., which states: For the sources (ID Nos. ES-1A and ES-1B), the Permittee shall demonstrate compliance by the dates specified in 40 CFR 63.11196 with all applicable requirements of 15A NCAC 2D .1111 "Maximum Achievable Control Technology" and 40 CFR 63 Subpart JJJJJJ "National Emission Standards for Hazardous Air Pollutants for Area Sources: Industrial, Commercial, and Institutional Boilers. ". This letter is to officially inform you that, by not complying with the cited requirement, you deviated from your air permit and from the cited federal regulation. Be aware that future deviations from air quality requirements could result in a Notice of Violation and corresponding penalties. Please provide this office a written response by 11 April 2014 that includes you're your timeline for conducting the energy assessment. Additionally, the Division strongly recommends that you carefully examine your current permit stipulations.
