Box 10836 1281 Powerhouse Dr. SE Southport,NC 27699 SUBJECT: Notice of Violation/Notice of Recommendation for Enforcement 15A NCAC 2D .0530: Prevention of Significant Deterioration (PSD) CPI USA North Carolina—Southport Plant Southport, North Carolina Brunswick County Facility ID: 1000067 Air Permit No. 05884T1I Fee Class: Title V Dear Mr. Kirby: The Division of Air Quality(DAQ)has reviewed your facility letter dated September 26, 2011 which identified that Unit 2 (ID No. ES-2) experienced a total of three (3) sulfur dioxide (S02) exceedances. The letter confirmed that you were in non-compliance with respect to the S02 emission limit determined on a 24 hour block average basis for Unit 2 (ID No. ES-2) on September 20, 21, and 22. The permit condition 2.1.A.4.b, "15 A NCAC 2D .0530 PSD", states that"Sulfur dioxide emissions from each source shall not exceed 1.47 pounds per million Btu heat input." The November 21, 2011 letter from Mr. Rick Houser, EHS Coordinator, identified the corrective actions that will be initiated to prevent future S02 exceedances. Please keep us up to date as those plans are implemented. Please submit a written response of additional information or description of any mitigating circumstances that you believe should affect the outcome of the enforcement evaluation. It is requested that the written response to this Notice be submitted as soon as possible, but not later than January 5, 2012. It should be noted that the violation cited in this letter or any additional documented violations will result in the initiation of an enforcement action by this office in accordance with North Carolina General Statute 143-215.114A, which provides for the assessment of civil penalties of up to $25,000 per day of violation.
