Dear Mr. Greene:
On August 29, 2001, Ms. Shawna Riddle and Mr. Bob Graves of this office performed
an inspection of the woodworking operation at Boone Lumber Company, located on Highway
90, Lenoir, North Carolina. During the inspection, it was discovered that excessive wood dust
emissions were exhausting from several leaks in the duct work installed on the woodwaste
collection system. Operating the system in this manner constitutes a violation of Air Permit No.
7444R General Condition and Limitation No. 6 which states in part:
The facility shall be properly operated and maintained at all times in a manner
that will effect an overall reduction in air pollution.
The facility is also operating in violation of 15A NCAC 2D .0512 "Particulates from Wood
Products Finishing Plants" which requires the following:
A person shall not cause, allow, or permit particulate matter caused by the
working, sanding, or finishing of wood to be discharged from any stack, vent, or
building into the atmosphere without providing, as a minimum for its collection,
adequate duct work and properly designed collectors...

During the inspection, it was also discovered that a copy of the Air Permit was not being kept
on-site. North Carolina Air Permit No. 7444R General Conditions and Limitations No. 14 states
in part:
The permittee shall retain a current copy of the Air Permit at the site. The
Permittee must make available to personnel of the DAQ, upon request, the
current copy of the Air Permit for the site.
This letter also serves as a Notice of Recommendation for Enforcement. The Asheville
Regional Office is considering sending a recommendation for assessment of a civil penalty to
the Director of the Division of Air Quality. It is requested that a written response to this
Notice of Recommendation for Enforcement be submitted to this office as quickly as
possible, but by no later than October 24, 2001. The response should outline the steps that
you plan to take or have taken to assure that the dust collection system can be operated in
compliance with the aforementioned regulation and permit condition at all times. If you have
an explanation for the violation that you wish to present, please include it in your response.
Your explanation will be reviewed and if an enforcement action is still deemed appropriate, your
explanation will be forwarded to the Director with enforcement package for his consideration.
The above violation, and any future violation of any air quality regulations are subject to the
assessment of civil penalties as per North Carolina General Statute 143-215.114A.
