Dear Mr. Mooney:
North Carolina Division of Air Quality evaluated the Petition for Exemption for the spray
coating operation that you submitted on July 7, 2009.
Under Subpart HHHHHH, National Emission Standards for Hazardous Air Pollutants:
Paint Stripping and Miscellaneous Surface Coating Operations at Area Sources, 40 CFR Part 63,
Section 63.11170(a)(2), promulgated by the US Environmental Protection Agency on January 9,
2008, all the facilities that comply with the definition Section 63.11180 of motor vehicle and
mobile equipment surface coating can submit a request for exemption. The request must include a
description of the spray applied coating operation, list of the manufactures and product lines and a
signed certification that your facility does not apply any coating containing the target HAPs;
chromium, manganese, nickel, cadmium or lead.
Section 63.11180, clearly defines motor vehicle and mobile equipment surface coating, as
the spray application of coatings to assembled motor vehicles or mobile equipment. Surface
coating of motor vehicle or mobile equipment parts or subassemblies at a vehicle assembly plant
or parts manufacturing plant is not included in operations allegeable for exemption.
After a review of our files, we found that your facility performs surface coating operations
of mobile equipment parts and not assembled motor vehicles or mobile equipment. Therefore,
your petition for exemption must be denied,
