Dear Mr. O'Neill:
The North Carolina Division of Air Quality (DAQ) Permits Section received your request for
a waiver from the performance test requirements, sent on your behalf from Environmental
Compliance Assurance Management (SCAM), on August 5, 2010. The request included a copy of
the summary from the test conducted in October 2005 and the cover letter. This was forwarded to
the Stationary Source Compliance Branch (SSCB) for review.
After reviewing the request, the supporting documentation, the regulations, and the
requirements for waiver approval, the DAQ is denying your request for a waiver from MACT
performance testing for the regenerative thermal oxidizer (RTO). Accordingly, you must complete
and submit performance test results demonstrating compliance with 40 CFR 63, Subpart JJJJ-
National Emission Standards for Hazardous Air Pollutants: Paper and Other TJ"eb Coating on or
before December 4, 2010.
Any violation of an air quality regulation is subject to the assessment of civil penalties as per
North Carolina General Statute 143-215.114A. This General Statute provides that civil penalties
of not more than twenty-five thousand dollars ($25,000) may be assessed against any person who
violates any classification, standard, limitation established pursuant to General Statute 143-
215.107,Air Quality Standards and Classifications. In addition, each day of continuing violation
