Box 340 Marshville,NC 28103 Subject: Notice of Violation— Operation without a Permit Rebel Lumber Wadesboro, Anson County, NC Facility ID No. 06/04-00058 Fee Class: Small Dear Mr. Little: On 4 November 2010, Cindy Grimes, of the Fayetteville Regional Office, Division of Air Quality(FRO DAQ), conducted an inspection of your facility located on Hwy 74 West,near Peachland, Anson County,NC. The purpose of this inspection was to evaluate if your facility required a North Carolina air quality permit. During the inspection, it was discovered that your facility operated a wood-fired boiler and eight lumber kilns, and was subject to air permitting under the North Carolina General Statute (NCGS) 143-215.108, "Control of sources of air pollution;permits required. " . This office received your completed air permit application on 31 December 2010. This letter is to inform you that you had been operating sources of air pollution without an air permit and were therefore in violation of the cited statute. As stated in the subject above, this letter represents a Notice of Violation for operating an unpermitted air emission source. This violation, and any future violation of an air quality regulation, is subject to the assessment of civil penalties per North Carolina General Statute 143- 215.114A. This General Statute provides that civil penalties of not more than twenty five thousand dollars ($25,000) may be assessed against any person who violates any classification, standard, or limitation established pursuant to General Statute 143-215.107, Air Quality Standards and Classification; In addition, each day of continuing violation after written notification from the Division of Air Quality shall be considered a separate offense.
