SUBJECT: Notice of Violation —2D .0521 "Control of Visible Emissions"

Dear Mr. Hodges:
On 7 November 2012 while driving on US-74, Robert Hayden of this office, noted
apparently excessive emissions from a stack on the roof of your facility, subsequently identified
as the stack for Tenter Frame 2 (ID no. TEN2 on the air permit). As stated in your permit
condition E.3, "As required by 15A NCAC 2D .0521, Control of Visible Emissions, for sources
manufactured after July 1, 1971, visible emissions shall not be more than 20 percent opacity
when averaged over a six-minute period." Mr. Hayden notified Mr. David Bruton, who went to
the observation point and agreed that the opacity was excessive. Hayden conducted a Visible
Emissions Evaluation (VEE), resulting in three opacity exceedences of 66%, 66% and 65%.
Later in the morning, Mr. Bruton contacted Mr. Hayden and informed him the situation was
corrected and was a result of the operator running the line at an excessive temperature. This
letter provides written notification that your facility was operating in violation of your air permit
and the cited regulation.
As stated in the "subject" above, this letter represents a Notice of Violation for failure to
comply with 2D.0521. The above violation, and any future violation(s) of an air quality
regulation are subject to the assessment of civil penalties according to North Carolina General
Statute 143-215.114A. This General Statute provides that civil penalties of not more than
twenty-five thousand ($25,000) dollars may be assessed against any person who violates or fails
to act in accordance with terms, conditions, or requirements of such permits pursuant to General
Statute 143-5.114(a)(2). In addition, each instance of continuing violation after written
notification from the Division of Air Quality will be considered a separate offense.

Please submit a written response to this office by 26 November 2012, as to actions
taken to bring about compliance and any additional information or description of any mitigating
circumstances in reference to the violation. Please include the following information in your
response
(i) the operational data for this tenter frame in question, including what time it
began operation on the day in question, the fabric type and description being
run, the excessive temperature you discovered causing the emissions, and the
target temperature.
(ii) please indicate how you propose to prevent the operators from adjusting the
temperature above a level that does not result in smoke above 20% opacity.
Please be advised that neither this letter, nor any subsequent action, absolves you from
responsibility for any violation or damage to public or private property or from any enforcement
action available to this agency.
This letter is to officially inform you that, by not complying with the cited air permit
stipulation, you deviated from your air permit and from the cited regulation. Be aware that
future deviations from air quality requirements could result in Notice of Violations and
corresponding penalties. Note that this deviation from the permit requirements should be
reported on the 2012 Annual Compliance Certification reports for the facility.
