Dear Mr. Densmore:
On April 4, 2013, the Division of Air Quality, Washington Regional Office (WaRO)
received the 40 CFR Part 63, Subpart ZZZZ (RICE)Applicability and Compliance Plan for
Regulator Marine's diesel-fired generator (emission source I-4). As discussed during our March
23, 2013 meeting, the engine is considered new, as construction commenced after the December
19, 2002 applicability date, and is required to meet the emissions limitations outlined in the
regulation. To date, Regulator Marine has not installed the necessary add-on controls to operate
within the limitations.
It should be noted in previous correspondence with PowerSecure, Inc. (September 23,
2005 response to an August 22, 2005 inquiry) DAQ concluded that PowerSecure, Inc.,who
operated the generator, was the responsible party regarding generator permitting and/or future
'i promulgated rules compliance. It has since been determined through DAQ review of the

regulation that Regulator Marine, as owner of the engine, is responsible for RICE compliance.

The Division of Air Quality has reviewed Regulator Marine's RICE Applicability and
Compliance Plan, and agrees to the following compliance schedule outlined below:
1. Performance Test Protocol -April 2, 2013 (received April 2, 2013)
2. Air Permit Application- April 17, 2013
3. Catalyst Equipment Leaves Manufacturing Facility - May 9, 2013
4. Catalyst Equipment Arrives on Site -May 15, 2013

Please note that this agreement is effective until July 12, 2013. In the event that any of
the scheduled events cannot be met by their respective date, Regulator Marine shall notify DAQ
by hard copy or email.as soon as possible and advise regarding the steps to resolve. If we can
