Dear Mr. Ham:
The Division of Air Quality (DAQ)received your request for a one year extension of your
compliance date for the "15A NCAC 21) .1109: CAA § 1120); Case-by-Case MACT for Brick
Manufacturers" (Permit 4384T36 Section 2.1.A(4)). The extension request is for two brick kilns,
ES-K3K and ES-K4K, each controlled individually by dry limestone adsorbers CD-K3DLA and CD-
K4DLA, respectively. The kilns are each described as:
"One coal/natural gas/propane-fired brick tunnel kiln (25.9 million Btu per hour heat input and
20.55 tons per hour maximum fired brick production rate)"
40 CFR 63.6(i)(6)lists the information that is required for the DAQ to act on your request.
Specifically:
(i) The request for a compliance extension under paragraph (i)(4) of this section shall
include the following information:
(A)A description of the controls to be installed to comply with the standard;
(B)A compliance schedule, including the date by which each step toward
compliance will be reached. At a minimum, the list of dates shall include:
(I) The date by which on-site construction, installation of emission control
equipment, or a process change is planned to be initiated; and
(2) The date by which final compliance is to be achieved.
(3) The date by which on-site construction, installation of emission control
equipment, or a process change is to be completed; and
(4) The date by which final compliance is to be achieved;
The NC DAQ has been delegated the implementation of the MACT standards and is therefore
considered the "Administrator."

The original request was submitted on March 25, 2014, which was greater than the required 120
days prior to the July 29, 2014 compliance date. The DAQ requested additional information on
April 4, 2014. General Shale responded with additional information dated April 8, 2014, which the
DAQ received on April 30, 2014.
Your request stated:
"Description of the controls to be installed to comply with the standard: Conversion from
coal to natural gas. "
You stated that General Shale will initiate conversion to natural gas by January 2015. Your
requested final compliance date would be July 29, 2015.
This letter serves as approval of your request for a one year extension. Your compliance date
will be July 29, 2015.
Please note that per 63.6(i)(4)(i)(A):
"The owner or operator of an affected source who has requested an extension of compliance
under this paragraph and who is otherwise required to obtain a title V permit shall apply for
such permit or apply to have the source's title V permit revised to incorporate the conditions
of the extension of compliance. The conditions of an extension of compliance granted under
this paragraph will be incorporated into the affected source's title V permit according to the
provisions of part 70 or Federal title V regulations in this chapter (12 U.S.C. 7661),
whichever are applicable. "
If you choose to use the extension, you shall apply for a modification to your permit.
