SUBJECT: 2nd Quarter 2001 Continuous Opacity Monitoring(COM) Excess Emissions
Report (EER)
Dear Mr. Reid:
The Division of Air Quality (DAQ)has reviewed Duke Power Company's fourth quarter
opacity excess emissions report (EER) dated July 24, 2001. The second quarter 2001 EERs
were reviewed for compliance with good operation and maintenance (O&M) practices as well
as compliance with 2D .0521.
When reviewed for compliance with good O&M practices, the data in the EERs indicate the
opacity excess emissions and COM downtime are within the target levels prescribed in the
CEM Enforcement Polices (CEP) and the Special Order by Consent (SOC) Agreement between
Duke Power and the Environmental Management Commission dated September 28, 1999.
When reviewed for compliance with 2D .0521, a total of ninety-five six-minute exceedances
were noted during the quarter. These exceedances were all below the actionable threshold.
As noted in your July 24, 2001 letter, Marshall Unit 4 exceeded the 2%criteria for excess
emissions with the actual at 2.15% during the reporting period. However as allowed by the air
permit for the facility, Duke Power examined the previous 2200 hours of operation data to
demonstrate that 1.13% excess emissions were less than the 2% criteria for the unit. As
required per SOC, Duke Power properly explained the circumstances that resulted in the excess
emission for Marshall Unit 4.
Finally, the DAQ will not issue any NOVs for these exceedances as specified with the SOC. As
long as the terms and conditions of the SOC are met, the DAQ will not pursue further
enforcement with regards to compliance issues related to .0521 regulations.
