Dear Mr.Cottrell:
Permit 10126R03, Specific Condition A.15.a.requires W.E.Partners II,LLC to conduct initial
performance testing of NOx,PM/PM10/PM2.5 and CO on the boilers to demonstrate compliance with limits set
under the Session Law 2007-397, Senate Bill 3 BACT determination. Specific Condition A.15.d.requires the
facility to submit testing protocols at least 45 days prior to air pollution testing. Specific Condition A.15.e.
requires notification of performance testing to the Division of Air Quality Regional Office, in writing, at least
15 days in advance of testing. It is the understanding of this office that W.E.Partners II,LLC conducted the
initial performance tests for the above pollutants on May 4,2017,without submittal of the permit required
protocols or the test date notification to the Washington Regional Office.
Failure to submit the test protocols and to notify the Regional Office of testing are violations of permit
Specific Conditions A.15.d. and A.15.e. Each violation can result in possible civil penalties as per North
Carolina General Statute 143-215.114A. A civil penalty may be assessed against a company who violates or
fails to act in accordance with the terms, conditions, and/or requirements of any permit issued under General
Statute 143-215.108.
Please remember to submit the protocols and regional notification of testing that are required for the
S133 BACT compliance demonstrations at the W.E.Partners I,LLC Cofield facility later this year. If you have
