Dear Mr. Bivens
On 19 April 2017, Mr. James Hodges,Environmental Manager,notified Joshua Harris of this
office of an electrical failure of the ORP controller for Packed Tower Scrubber(ID No. C-4),which
occurred on 18 April 2017 at your facility in Anson County,North Carolina. Additionally,this office is
in receipt of your letter dated 19 April 2017 regarding the events of 18 April 2017. Your claim that an
unavoidable equipment failure did not lead to excess emissions has been reviewed. Based on the
information you submitted,this office has determined that there was the potential for the release of
excessive malodorous emissions, and the event reported will be considered by this Division as a
malfunction as defined in 15A NCAC 2D .0535(a)(2).
