Dear Mr. Hildreth,
Your current air permit, identified above, includes one (1) specific condition requiring
that a report be sent to this office no later than 1 March 2017: condition A.8.d., 2D .1104,
"Toxic Air Pollutant Control Requirements." Your facility failed to comply with this
requirement. The report was received in this office on 9 March 2017. Once the report is
reviewed, a compliance determination, based upon the content of the reports, shall be made.
This letter is to officially inform you that by failing to submit the required report by the due date
you violated your air permit and the North Carolina Administrative Code 15A NCAC 2D .1104 _
Toxic Air Pollutants Control Requirements.
As stated in the subject above, this letter represents a Notice of Violation for the cited
violation. This violation, and any future violation of an air quality regulation, is subject to the
assessment of civil penalties according to North Carolina General Statute 143-215.114A,
Please submit a written response no later than 4 April 2017. Include in your response
the steps that you plan to take or have taken to return to compliance, and any additional
information or description of any mitigating circumstances in reference to the aforementioned
violation.
