Dear Mr.Roark:
This letter is to inform you that the quarterly report, as required by Air Quality Permit No.00481R19,
condition A.12 for the purpose of complying with 15A NCAC 2D .1100,"Control of Toxic Air Pollutants,"
was received by this office on January,30,2018. Although the report was received on time,it contained an
exceedance of the total annual allowable amount of No. 2 fuel oil combusted within the liquid,asphalt heater
(Source ID H-1). You reported a total of 46,626 gallons,whereas the allowable limit is 27,005 gallons. On
January 30,2018,Mr.Paul Williams,Environmental Specialist, contacted Mr. Sean Mackey regarding this
reporting exceedance. During this conversation,Mr.Mackey explained that the amount of No.2-fuel oil that
was reported was not the actual amount which was combusted,but the total amount delivered to the facility in
2017. Mr.Mackey also stated that he had no way to know the amount of No.2 fuel oil combusted in the liquid
asphalt heater. By failing to meet the required reporting criteria by the due date,you are deficient in fulfilling
the requirements of Permit Condition A.12.
It should be noted that the reporting requirement,associated with current Permit Condition A.12(b)(i),
states in part:"The total amount[tons] of hot mix asphalt produced and the total amount of[gallons] of No.2
fuel oil combusted in the liquid asphalt heater(H-1)."
Please send the updated information as soon as possible but no later than March 5,2018. Please also
include in your response an explanation of why this deficiency occurred and the steps you have taken to ensure
that all future reports are received on time and accurate. Failure to submit reports in a timely and accurate
manner may result in a violation. All violations of air quality regulations are subject to enforcement action,
including a civil penalty,pursuant to NCGS 143-215.114A. You may wish to contact the Division of
