Post Office Box 369 Harrisburg,NC 28075 Subject: Notice of Substantive Complaint NCAC 2D .0540 ,Particulates from Fugitive Dust Emission Sources," Galvan Industries, Inc Facility ID: 1300029 Harrisburg„North Carolina Cabarrus County Dear Mr. Londhe: The Mooresville Regional Office of the North Carolina Division of Air Quality(DAQ)received a complaint on August 3,2017,regarding dust emissions from Galvan Industries,Inc. Enclosed please find a copy of North Carolina Administrative Code Title 15A 2D.05401,Particulates from Fugitive Dust Emission Sources,".This regulation states in part: If fugitive dust emissions from a facility required to comply with this Rule cause or contribute to substantive complaints, the owner or operator of the facility shall: (1) within 30 days upon receipt of written notification from the Director of a second substantive complaint in a 12-month period,submit to the Director a written description of what has been done and what will be done to reduce fugitive non-process dust emissions from that part of the facility that caused the second substantive complaint; (2) within 60 days of the initial report submitted under Subparagraph(1) of this Paragraph, submit to the Director a control plan as described in Paragraph (f) of this Rule; and (3) within 30 days after the Director approves the plan,be in compliance with plan. Therefore,this Notice of Substantive Complaint is hereby issued to Galvan Industries, Inc. for the above referenced regulation. Please note,that according to the enclosed regulation,if a second substantive complaint is received by this office within the next twelve months,the company will have to comply with the provisions as stipulated in NCAC 15A 2D .0540. It is requested that a written response to the Notice of Substantive Complaint be submitted to this office as quickly as possible, but no later than 30 days following receipt of this notice. The response should include what, if any, actions the company has taken to prevent a reoccurrence of the problem.
