SUBJECT: COMPLIANCE EVALUATION INSPECTION
New Hope Commons Development
Dear I& Holman:
On October 6, 1997 representatives from the North Carolina Division of Water Quality conducted a
compliance evaluation inspection at the aforementioned site. This inspection revealed that (among other items of
concern) the stormwater pond had not been adequately cleaned out or maintained. This inspection resulted in an
October 10, 1997 Notice of Violation in which these problems were detailed.
Subsequent to these events, Mr. Glenn Garrett of Retention Pond Services, Inc. telephoned me and arranged a
site visit to document the corrective actions undertaken at the site. On November 5, 1997 Mr. Eric Fleek and Mr. Pete
Colwell from NCDWQ met with Mr. Garrett. As a result of this inspection it was noted that the stormwater pond had
been cleaned out, vegetation removed, the erosion in and around the outlet structure had been addressed with a large
quantity of stone, and the trash wrack had been repaired and improved. However, despite these measures it seemed
apparent to DWQ during the inspection that the pond depth is insufficient to handle the hydraulic flows exiting from
the impervious surfaces. Specifically, the east end of the pond was totally dry and the west end had only approximately
1 foot of permanent pool depth. Upon further review by our stormwater engineer, DWQ has determined that the
permanent pool elevation of this pond should be approximately 4 feet. As already noted, the maxi*num present depth of
the permanent pool depth is approximately 1 foot. Therefore, additional excavation of this pond v ill be required to
attain the necessary 4-foot permanent pool depth On the morning of December 5, 1997 I spoke with Mr. Garrett and
informed him of this requirement while he noted that he would convey this information to representatives of
Developers Diversified.
We appreciate your efforts in complying with the conditions of your 401 Water Quality Certification. To this
continued end, we request that you provide this office with information regarding your plans to adequately excavate
this pond to the previously noted depth as soon as possible. If you should have any questions regarding this matter

SUBJECT: NOTICE OF VIOLATION
New Hope Commons Development
Dear Mr. Holman:
On July 30, 1997 you were issued General Water Quality Certification Number 3101 authorizing
you to impact 0.1 acres of wetlands or waters for the purpose of constructing a sewer line at New Hope
Commons at U.S. 15-501 and I-40 in Durham County. Additional conditions of this Certification included
the submission (to DWQ) of an Operation and Maintenance Plan for the wet detention pond and that this
pond be cleaned out. The Operation and Maintenance Plan was to be submitted to DWQ within 30 days of
the July 30, 1997 Certification. As of this writing this office has yet to receive a copy of the operation and
maintenance plan. If we do not receive this operation and maintenance elan within 14 days of recut
of this letter with a s ific date for the maintenance to occur, the North Carolina Division of Water
Ouality (NCDWO) will move to REVOKE the Water Ouality Certification for this project in
accordance with 15A NCAC 211.0507 (d) (1).
On October 6, 1997 as part of an ongoing compliance monitoring and enforcement program Mr.
Eric Fleek, Mr. Pete Colwell, Ms. Cyndi Bell, and Mr. Brian Smith from the Division's Central office
conducted a compliance evaluation inspection at the aforementioned facility. From the inspection it was
determined that the wet detention pond did not appear to be adequately cleaned out. There was a significant
quantity of plant/ woody debris on the outlet structure. This blockage was causing the flow of water from
the stormwater collection system to short-circuit the pond. This was clearly evidenced by the fact that
vegetation on the south side of the pond had been pushed down by water flow and the nearby occurrence of
strong wrack lines. Further, there was a profuse growth of vegetation in and around the fringe of this wet
detention pond. This vegetation should be removed so that the designed storage capacity of the pond is not
further reduced. In addition, the area around the outlet pipe from the collection system was also eroding due
to extreme high flows. This area should be more permanently stabilized.
You are again requested to submit a copy of the Operation and Maintenance Plan to this office
within 14 days upon receipt of this letter. You are also required to clean out the wet detention pond outlet
structure and remove the vegetation from the pond's fringe. An additional compliance evaluation
inspection will be conducted soon to verify that the retention pond has been cleaned out. By copy of this
letter we are requesting that the U.S. Army Corps of Engineers (USACOE) place any current or pending

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Holman:
You have our approval, in accordance with the attached conditions and those listed below, to place
fill material in 0.1 acres of wetlands or waters for the purpose of constructing a sewer line at New Hope
Commons, as you described in your application dated 27 May 1997. After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification Number 3101. This
certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of
Engineers. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us
a new application. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
Within 30 days of the date of this Certification, applicant shall clean out the retention pond in the
rear of New Hope Commons and submit to DWQ an Operation and Maintenance Plan for that pond.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean
Water Act. If you have any questions, please telephone John Dorsey at 919-733-1786.

their Water'Quality Certification pending the receipt of this plan and the specific date for the

This Is an overview of the Operation and Maintenance Plan for the wet: retention ponds at New
Hope Commons and the response to your letter dated October 10, 1997 reference DWQ
0970471. Effective 10124197, Developers Diversified has placed the aforementioned wet
retention ponds under a maintenance contract with Retention Pond Services, Inc. (RPS). The
initial #erm of this contract Is 10/24/97 to 12131198.
The klowing is an overview of the maintenance and inspections to be.performed on the New
Hope2Gommons wet retention pond system.
Monthly
Inspect the trash rack; remove accumulated debris, repair/replace the rack if it Is not functioning
properly.
Inspect and clear intake orifice of any obstructions.
Inspect the pond side slopes and grassed inlet swales. Any eroded areas will be noted in the
remarks section of the report and promptly repaired.
if the `:pond is operated with a vegetative filter, the filter will be checked.for sediment
accumulation, trash accumulation, erosion and proper operation of the flow spreader control.

inspect the collection system (including catch. basins, piping, grassed Swale) for proper

depth is reduced to 75% of the original design depth, measured vertically from the orifice down

Exhibit A provides a list of the covered services provided under RPS Monthly Maintenance
Agreement.
The small retention pond at New Hope Commons is scheduled for Its annual inspection on
October 25, 1997. The larger ret6ntion pond (pond with fountain) had an annual Inspect
performed by RPS on July 18, 1997. The above schedule of maintenance will be strictly followed
by RPS for the duration of the contract. Please forward a copy of any correspondence

You have our approval., in accordance with the attached conditions and those listed below, to place
fill material in 0.1 acres of wetlands or waters for the purpose of constructing a sewer line at New Hope
Commons, as you described in your application dated 27 May 1997. After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification Number 3101. This
certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of
Engineers. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying
404 or CAMA permit expires unless otherwise speed in the General Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us
a new application. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional
conditions listed below.
Within 30 days of the date of this Certification, applicant shall clean out the retention pond in the
rear of New Hope Commons and submit to DWQ an Operation and Maintenance Plan for that pond.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

On 27 May 1997 the Division of Water Quality (DWQ) was notified by receipt of your
application regarding your plan to fill wetlands for the purpose of constructing a sewer line
at New Hope Commons at US 151501 and I-40 in Durham County. Approval from DWQ
is required to disturb these wetlands. We wrote to you on 4 November 1996 and 22 April
1997 concerning maintenance problems at the stormwater pond on this site. I inspected the
site on 24 June 1997 and found that the pond had not been cleaned out. We cannot process
this current application as a General Certification unless we have a written commitment
regarding maintenance on the pond (including an Operation and Maintenance Plan). If such
a commitment is not received by 15 July 1997, we will have to put this project out to Public
Notice for an Individual Certification. Until this information is received, this application is
incomplete and our processing time will not start.

Reference is made to the enclosed survey plat titled "NcH HOPB Comc)NS
WRTL,ANDS SURVEY'. The survey plat accurately reflects the limits of wetlands
on your property As delineated by your environmental consultant, Mr. Clement
Riddle with Law Engineering. Specifically, your property is located southwest
of Mount Moriah Road (S.R. 1113), northwest of H.C. Highway 15-501, northwest
of interstate 40, adjacent and above the headwaters of an unnamed tributary to
New Hope Creek, in Durham, Durham County, worth Carolina. Unless there is a
change in the law or our published regulations, this determination of the
limits of wetlands may be relied upon for a period not to exceed March 29,
1997.
Pursuant to Section 404 of the Clean Water Act, prior Department of the
Army approval is required for the discharge of dredged or fill material in
waters of the United States, including wetlands.
Please reference your application of March 29, 1994, for Department of
the Array (DA) authorization to impact 2.29 acres of wetlands associated with
the installatidn of a 3,335 foot sewer line to connect the development.on the
New Hope Commons with an existing sewer line. Specifically, the sewer line
will be constructed on an adjacent tract of land located on the north side of
Mount Moriah Road, approximately 100 feet northwest of N.C. Highway 15-501,
adjacent and below the headwaters of New Hope Creek, in Durham, Durham County,
North Carolina.
For the purposes of the Corps of Engineers, Regulatory Program, Title
33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 404 of the Clean Water Act. was provided for the discharge
of material for backfill or bedding for utility lines, including outfall and
intake structures, provided there is no change in pre-construction contours.
Your proposed work is authorized by this nationwide permit provided it
is accomplished in strict accordance with the enclosed conditions and provided
you receive a Section 401 water quality certification from the North Carolina
Division of Environmental Management (NMRM). You should contact Mr. John
Dorney, telephone (919) 733-1786, regarding water quality certification. This
nationwide permit does not relieve you of the responsibility to obtain other
required State or local approval.
This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
Also. this verification will remain valid for the two years if, during that
period, the nationwide permit authorization is reissued without modification

or the activity complies with any subsequent modification of the nationwide
permit authorization. If during the two years, the nationwide permit
authorization expires or is suspended or revoked, or is modified, such that
the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced (i.e., are under
construction) or are under contract to commence in reliance upon the
nationwide permit will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration,
modification or revocation, unless discretionary authority has been exercised

You have our approval to place fill material in 0.60 acres of wetlands or waters for the
purpose of shopping center development at New Hope Commons, as you described in your
application dated 21 March, 1994. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Number 2671. This certification allows you to
use Nationwide Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application.
If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached
certification. Flow from the stormwater pond shall be directed to sheetflow across the downslope
wetland. The pond shall be located as shown on your 5 May, 1994 submittal. In addition, you
should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to
the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification
and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

Dear Sir or Madam:
On behalf of our client, Homart Community Services, we respectfully request your written
concurrence concerning the applicability of Nationwide Permit No. 12 (NWT 12) for the
construction of 3,335 foot sewer line connecting the development on the - New Hope
Commons with an existing sewer line. New Hope commons is located adjacent to Interstate
40 and U.S. Highway 15 and 501 and is bordered to the-west by a tributary of New Hope
Creek. Wetlands on the New Hope Commons site were delineated by Mr. Clement Riddle
and Mr. Fred Smith of Law Companies on 21 January 1994 and were field verified by Ms.
Jean Benton of the U.S. Army Corps of Engineers on 15 February 1994. During this visit
the Ms. Benton walked the proposed sewer line right-of-way.
The jurisdictional areas within the proposed sewer line right-of-way have not been
delineated or verified to our knowledge. For your information, we are enclosing copies of
the following: Site Location Map, Survey of proposed sewer line, and Soils Map.
It is our understanding that sewage access construction is authorized under NWP 12. The
permit authorizes discharge of material for backfill or bedding for sewer lines, provided

there is no change. in preconstruction contours. Preconstruction contours will be restored
at the conclusion of the sewer access construction. All fill associated with construction will
be stockpiled for less than 60 days or removed to an upland disposal site.
We respectfully request written concurrence of your agreement with our findings concerning
the applicability of NWP 12 for the proposed work.
