Box 8022 Chagrin Falls, OH 44022-8022 LT.X*A D EHNR December 5. 1997 Durham County DWQ# 970471 FILE COPS' SUBJECT: COMPLIANCE EVALUATION INSPECTION New Hope Commons Development Dear I& Holman: On October 6, 1997 representatives from the North Carolina Division of Water Quality conducted a compliance evaluation inspection at the aforementioned site. This inspection revealed that (among other items of concern) the stormwater pond had not been adequately cleaned out or maintained. This inspection resulted in an October 10, 1997 Notice of Violation in which these problems were detailed. Subsequent to these events, Mr. Glenn Garrett of Retention Pond Services, Inc. telephoned me and arranged a site visit to document the corrective actions undertaken at the site. On November 5, 1997 Mr. Eric Fleek and Mr. Pete Colwell from NCDWQ met with Mr. Garrett. As a result of this inspection it was noted that the stormwater pond had been cleaned out, vegetation removed, the erosion in and around the outlet structure had been addressed with a large quantity of stone, and the trash wrack had been repaired and improved. However, despite these measures it seemed apparent to DWQ during the inspection that the pond depth is insufficient to handle the hydraulic flows exiting from the impervious surfaces. Specifically, the east end of the pond was totally dry and the west end had only approximately 1 foot of permanent pool depth. Upon further review by our stormwater engineer, DWQ has determined that the permanent pool elevation of this pond should be approximately 4 feet. As already noted, the maxi*num present depth of the permanent pool depth is approximately 1 foot. Therefore, additional excavation of this pond v ill be required to attain the necessary 4-foot permanent pool depth On the morning of December 5, 1997 I spoke with Mr. Garrett and informed him of this requirement while he noted that he would convey this information to representatives of Developers Diversified. We appreciate your efforts in complying with the conditions of your 401 Water Quality Certification. To this continued end, we request that you provide this office with information regarding your plans to adequately excavate this pond to the previously noted depth as soon as possible. Box 8022 Chagrin falls, OH 44022-8022 SUBJECT: NOTICE OF VIOLATION New Hope Commons Development Dear Mr. Holman: On July 30, 1997 you were issued General Water Quality Certification Number 3101 authorizing you to impact 0.1 acres of wetlands or waters for the purpose of constructing a sewer line at New Hope Commons at U.S. 15-501 and I-40 in Durham County. Additional conditions of this Certification included the submission (to DWQ) of an Operation and Maintenance Plan for the wet detention pond and that this pond be cleaned out. The Operation and Maintenance Plan was to be submitted to DWQ within 30 days of the July 30, 1997 Certification. As of this writing this office has yet to receive a copy of the operation and maintenance plan. If we do not receive this operation and maintenance elan within 14 days of recut of this letter with a s ific date for the maintenance to occur, the North Carolina Division of Water Ouality (NCDWO) will move to REVOKE the Water Ouality Certification for this project in accordance with 15A NCAC 211.0507 (d) (1). On October 6, 1997 as part of an ongoing compliance monitoring and enforcement program Mr. Eric Fleek, Mr. Pete Colwell, Ms. Cyndi Bell, and Mr. Brian Smith from the Division's Central office conducted a compliance evaluation inspection at the aforementioned facility. From the inspection it was determined that the wet detention pond did not appear to be adequately cleaned out. There was a significant quantity of plant/ woody debris on the outlet structure. This blockage was causing the flow of water from the stormwater collection system to short-circuit the pond. This was clearly evidenced by the fact that vegetation on the south side of the pond had been pushed down by water flow and the nearby occurrence of strong wrack lines. Further, there was a profuse growth of vegetation in and around the fringe of this wet detention pond. This vegetation should be removed so that the designed storage capacity of the pond is not further reduced. In addition, the area around the outlet pipe from the collection system was also eroding due to extreme high flows. This area should be more permanently stabilized. You are again requested to submit a copy of the Operation and Maintenance Plan to this office within 14 days upon receipt of this letter. You are also required to clean out the wet detention pond outlet structure and remove the vegetation from the pond's fringe. An additional compliance evaluation inspection will be conducted soon to verify that the retention pond has been cleaned out. Box 8022 Chagrin Falls, OH 44022-8022 Dear Mr. Holman: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.1 acres of wetlands or waters for the purpose of constructing a sewer line at New Hope Commons, as you described in your application dated 27 May 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3101. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Within 30 days of the date of this Certification, applicant shall clean out the retention pond in the rear of New Hope Commons and submit to DWQ an Operation and Maintenance Plan for that pond. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Flow from the stormwater pond shall be directed to sheetflow across the downslope wetland. The pond shall be located as shown on your 5 May, 1994 submittal. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. New Hope commons is located adjacent to Interstate 40 and U.S. Highway 15 and 501 and is bordered to the-west by a tributary of New Hope Creek. Wetlands on the New Hope Commons site were delineated by Mr. Clement Riddle and Mr. Fred Smith of Law Companies on 21 January 1994 and were field verified by Ms. Jean Benton of the U.S. Army Corps of Engineers on 15 February 1994. During this visit the Ms. Benton walked the proposed sewer line right-of-way. The jurisdictional areas within the proposed sewer line right-of-way have not been delineated or verified to our knowledge. For your information, we are enclosing copies of the following: Site Location Map, Survey of proposed sewer line, and Soils Map. It is our understanding that sewage access construction is authorized under NWP 12.
