GRIFFIN SUBJECT: MODIFICATION REQUZST TO CAMA PERMIT #70-92 DATE: MARCH 21, 1994 LAMA permit 070-92 was issued to NC DOT authorizing the construction of Bridge 105 over Colington Creek in Dare County. Recently, during construction of this bridge, NC DoT discovered that the placement of concrete sheet piles to construct the bridge abutment retainer walls was causing displaced sediment to fill Colington Creek. NC DCM immediately stopped the placement of these concrete sheet piles and met onsite with NC DOT engineers- NC DOT realized the problems associated with the placement of these piles. They have decided to abandon the placement of these piles and instead to stabilize the bridge abutments with rock rip rap. To this and, NC DOT is requesting a modification of their LAMA permit to allow the placement of rock rip rap around the bridge abutments for Bridge #5. The placement of rock rip rap will impact an additional 600 square feet of coastal wetlands which were not originally proposed nor permitted to be impacted- NC DOT proposca to mitigate for the loss of these wetlands during the soon-to-be- filed CAMA permit application for the widening of Colington Road. Please review the attached letter and plats and submit your comments to John Parker on or before April 5, 1994. Please reference the March 1 letter from Mr. David Griffin to this office. Mr. Griffin stated that sheet pile installation activities associated with the construction of bridge 5 over Colington Creek have resulted in unacceptable discharge into State waters. It was further stated that NCDOT has been requested to suspend the placement of sheet piling until NCDOT can address this situation. NCDOT personnel have met with DCM representatives to discuss options that would prevent the discharge of displaced material into Colington Creek. As a result of this coordination, NCDOT has decided to discontinue driving concrete sheet piles on this project, and use another method to stabilize the faces of the bridge abutments. NCDOT now proposes to use class IT rip_rap_Jo "stabilize these faces. The rip-.rap will extend from the face iabric'wail to'ground elevation. The rip-rap will be placed on a 11:1 slope, which is the steepest possible elope for this type of material. Sheet 1 of 2 (enclosed) shows the concrete bulk originally proposed, while sheet 2 of 2 depicts typical cross-sections showing the extent of new impact associated with the currently proposed rip-rap. The placement of this rip rap will lead to an additional impact into coastal wetlands of approximately 600 square feet. For the purposes of mitigation, NCDOT proposes to include this impact with those associated with the future =iPR-14-194 THU 14:41 ID:DIU OF CORSTAL MGMNT TEL NO:C919) 733-1495 #648 P03 --- 1 widening of SR 1217. Permit and mitigation coordination for this widening should begin within the next two to three months. PROJECT SUMMARY: The applicant proposes to widen existing pavement on Colington Road (SR 1217) to 22' width, replace three drainage pipes under the roadway with longer pipes and construct a 175' long stormwater drain, NC DOT - SR 1217 Colington Road Bio Report Page Two Site Description - The NC Department of 'T'ransportation is proposing to widen and resurface 2.5 miles of SR 1217 (Colington Road). The project excludes the area adjacent the two bridges currently being constructed over Colington Cut and Colington Creek. These two bridges were authorized by CAMA Permits #170-92 and #71-92 issued July 29, 1992. The roadway will be widened an additional 2-3' to a total width of 22 feet. No widening is proposed within wetlands, although the need to replace and lengthen existing drainage pipes at three locations will result in the filling of a small area of shallow water habitat and an even smaller area of wetlands. The placing of fill within wetlands and within shallow water at the ends of the three pipes is proposed in order to prevent further erosion of the roadway shoulder. All work is proposed within NC T)0'1''s existing right-of-way except for the installation of a 175' long 18" diameter reinforced concrete pipe designed to eliminate an existing drainage problem near the entrance gate of the Colington Harbor Subdivision. The pipe would connect to a drop inlet located a few feet off the pavement, pass through an existing bulkhead and empty stormwater into an existing manmade canal off Kitty Hawk Bay. The waters of which are classified as SC by North Carolina's Division of Environmental Management. At the easternmost drainage pipe replacement site (station 92+00) is a 2-3' wide fringe of coastal wetlands vegetated with a mixture of sawgrass (Cladium jamaicense), cattail (Typha spp), and bulrush (Scirpus ??p..). At the opposite end of the pipe are two patches of cattail approximately 6' in width. Approximately 160 sq. ft. of these wetlands would be filled as part of this proposed pipe replacement. At the second pipe replacement site (station 115+00) the south end of the existing pipe is surrounded with a 2-3' wide fringe of salt reed grass (Spartina cvnosuroides), bulrush (Scirpus app.) and saltmeado\v grass (Spartina patens). Approximately 42 sq. ft. of wetlands currently existing at this replacement site are proposed to be filled. At the third pipe replacement site (near station 149+00) approximately 40 sq. ft. of wetlands supporting cattails located at each end of the existing pipe would be filled as a result of the proposed replacement. Anticipated Impacts The placing of an additional strip of asphalt 2-3' in width along the 2.5 mile long project will result in the disturbance; filling of 33,000 sq. ft. of upland area. At some locations all of the proposed 22' surfaced area will lie within the 75' wide Estuarine Shoreline Area of Environmental Concern with a resultant lot coverage by impervious surfaces of 29.3%. At the three pipe replacement locations, fill placed at the ends of the longer NC DOT - SR 1217 Colington Road Bio Report Page Three - replacement pipes will impact 242 sq. ft. of wetlands and 712 sq. ft. of shallow water habitat. In addition to the 954 sq. ft. of impact which is being proposed for this project, 600 sq. ft. of waters/wetlands were impacted at the Colington Cut Bridge site, where concrete sheet piles were replaced with riprap in order to reduce turbidity. As part of this modification to CAMA Permit #f70-92, NC DOT agreed to include mitigation for this 600 sq. ft. of loss with the mitigation for impacts associated with the widening of SR 1217. In order to mitigate for both projects, NC DOT proposes to deduct 0.071 acres (1554 sq. ft. at 2:1 ratio) from the marsh creation site at Colington Cut. After debiting this 0.071 acres NC DOT proposes to utilize the 0.169 acres of undebited mitigation site for future highway projects in the area. No cultural resources have been identified in the area. The North Carolina Department of Transportation proposes to widen and resurface SR 1217 (Colington Road) fromthe SR 1217/NC 12 intersection to the western end of the roadway. The roadway will be widened to a width of 22 feet. Resurfacing will take place along the entire 1'ength of the roadway except in the areas adjacent to the bridges being constructed over Colington Cut and Colington Creek. The widening and resurfacing of the roadway adjacent to-these two bridges has previously been authorized by CAMA Permit 70-92. Traffic will be maintained on existing roads during construction. No roadway widening will take place in wetlands, although the need to replace and lengthen three drainage pipes will result in a small amount of impact to wetlands (0.005 acres) and Waters of the U.S. (0.016 acres). The need to prevent further undercutting of the roadway shoulder necessitates the placement of fill at these pipe replacement locations. All work will take place within. existing NCDOT right of way, with one exception. The Department has obtained a drainage easement to construct a 18" reinforced concrete pipe at station 159+00. This pipe will connect to a drop inlet adjacent to the roadway shoulder, extend for 175 feet and pass through an existing bulkhead (see sheet 55 of 61). An easement has been obtained from two property owners (Randy M. Saunders and William D. Head) authorizing this action. A copy of the easement has been requested from NCDOT's Division 1 construction office, and will shortly be provided to your office. NCDOT proposes to utilize a portion of a marsh creation site near the bridge over Colington Creek to mitigate for the 954 square feet of wetland and waters impacts associated with this project. This marsh creation area is a portion of a mitigation site created to offset losses associated with the construction of the Colington Cut and Colington Creek bridges. The mitigation site was originally to be only 0.04 acres in size. However, it has since been determined that a larger portion of an old canal would be available for mitigation purposes than was originally estimated. An additional 0.24 acres (see enclosed mitigation figure) has been planted with Juncus grass. The Department therefore proposes to debit 1908 square feet (0.022 acres), which represents the 954 square feet impact and a 2:1 mitigation ratio, from this mitigation area. In addition to the 954 square feet of impacts associated with the widening and resurfacing of SR 1217, 600 square feet of waters and wetlands were recently impacted at the Colington Cut bridge. This additional impact was necessitated due to the need to utilize rip rap instead of concrete sheet piles to reduce turbidity. In a March 11, 1994 request for a modification to CAMA permit 70-92, NCDOT agreed to include this 600 square foot impact with the impacts associated with the SR 1217 widening for mitigation purposes. The Department therefore proposes to debit an additional 1200 square feet (0.027 acres), which represents the 600 square feet impact and a 2:1 mitigation ratio, from the mitigation area. The total proposed debit from this mitigation area equals 0.049 acres. The Department further proposes to utilize the un-debited portion of the mitigation site (0.191 acres) for mitigation for future highway projects in the area. NCDOT is requesting that the proposed work be authorized under the appropriate Coastal Area Management Act-(CAMA) permit. By copy of this application, NCDOT requests issuance of the appropriate Section 404 permit from the Army Corps of Engineers. A 401 Water Quality Certification from the N.C. Division of Environmental Management will be required. Division of Environmental Management will begin review of this project during the CAMA public notice process. The sites consist of approximately 1.27 acres of mitigation for marsh wetland impacts associated with project B- 2024. 1.2 Purpose In order for a mitigation site to be considered successful, a site must meet success criteria in both hydrology and vegetation. This report details the vegetation monitoring in 1999 at the Colington Cut Mitigation Site. The Colington Creek site was previously closed out on October 15, 1999, having met vegetation success. The on site area at Colington Cut was mowed in April 1999 and treated in June 1999 for phragmites. The western side of the site had less than 1% phragmites at `ime of monitoring. The phragmites at the eastern end was stressed due to treatment. Most of the planted area has become established with mixed Juncus roemerianus and Scirpus. 2.4 Conclusions There were approximately 1.27 acres of marsh planted both on site and off site. There were no plots established on either site. By visual observation the Colington Cut Site is averaging around 50% areal coverage of Black Needlerush and Scirpus. The phragmites treatment in June 1999 has worked exceptionally well on the western end of the site. While the phragmites on the eastern end appeared stressed, it may require an additional treatment. Site 3 had been established and was blending in well with the adjacent marsh. It had a cover of aprroximately 80% Spartina, 15% Scirpus, and 5% Juncus. By visual observation, it had been determined that approximately 75% of the planted species had survived, covering approximately 88% of the sites. As of the 1997 Annual Report (2"d year), the vegetation results were as follows: Site % Coverage 1 20% 2 20% 3 100.0% Average 46.7% Sites 1 and 2 continued to be infested with Phragmites, but a small area of Juncus still remained at the site. Proposed remedial action by NCDOT included plans to treat the Phragmites infestation of sites 1 and 2 with an appropriate herbicide application in 1998. Site 3 had a cover of approximately 90% Spartina, 5% Scirpus, and 5% Juncus. It continued to blend in well with the adjacent marsh. By visual observation, the sites averaged approximately 47% cover with a continued 75% survival of the species planted. During the third year of vegetation monitoring in 1998, the vegetation results were as follows: Site Juncus Scirpus Spartina % Coverage (3 roemerianus alterniflora years) Colinton Cut 1% NA NA 1% (Sites 1&2) Colington 20% 5% 75% 100% Creek (Site 3) By visual observation, the planted area at Colington Cut was averaging 1 % aerial coverage of Juncus which was growing around the fringes of the site. This low percentage rate was due to the continued heavy competition of Phragmites and is below the required success criteria. In response to this problem the infested areas were mowed and teated with herbicide to help control the Phragmites. The planted area at Colington Creek, however has done exceptionally well. The entire planted area has become established predominately with Spartina alterniflora mixed with Juncus roemerianus and Scirpus. Dear Mr. Huggett, The North Carolina Department of Transportation (NC DOT) has monitored the referenced mitigation site since 1995. No hydrologic monitoring was required on this site. Vegetation monitoring has been conducted for.three growing seasons. The sites are located at Bridges No. 5 and No. 6 along SR 1217 in Dare County. They consist of approximately 1.27 acres of marsh total and include the following communities: Brackish Marsh on-site (creating approx. 0.50 ac) Brackish Marsh off-site (creating approx. 0.63 ac) Brackish Marsh off-site (restoring approx. 0.14 ac) The sites were planted in July 1995. No plots were established. Sites 1- and 2 known as Colington Cut and Site 3 known as Colington Creek were both planted with Juncus roemerianus. Site 3 was also planted with Spartina altemiflora and Scirpus. Vegetation monitoring began in August 1995. The success criteria established requres a 50% survival rate of planted species and 50% aerial coverage for at least three consecutive years. At the time the 1996 Annual Report (1St year of monitoring) was prepared, the vegetation results were as follows: Site % Coverage 1 85% 2 85% 3 95% Average 88.3% Sites 1 and 2 had heavy infestation of Phragmites; however, Juncus was still present. Site 3 had been established and was blending in well with the adjacent marsh. It had a cover of aprroximately 80% Spartina, 15% Scirpus, and 5% Juncus. By visual observation, it had been determined that approximately 75% of the planted species had survived, covering approximately 88% of the sites. As of the 1997 Annual Report (2nd year), the vegetation results were as follows: Site % Coverage 1 20% 2 20% 3 100.0% Average 46.7% Sites 1 and 2 continued to be infested with Phragmites, but a small area of Juncus still remained at the site. Proposed remedial action by NCDOT included plans to treat the Phragmites infestation of sites 1 and 2 with an appropriate herbicide application in 1998. Site 3 had a cover of approximately 90% Spartina, 5% Scirpus, and 5% Juncus. It continued to blend in well with the adjacent marsh. By visual observation, the sites averaged approximately 47% cover with a continued 75% survival of the species planted. During the third year of vegetation monitoring in 1998, the vegetation results were as follows: Site Juncus Scirpus Spartina % Coverage (3 roemerianus alterniflora years) Colinton Cut 1% NA NA 1% (Sites 1 &2) Colington 20% 5% 75% 100% Creek (Site 3) By visual observation, the planted area at Colington Cut was averaging 1 % aerial coverage of Juncus which was growing around the fringes of the site. This low percentage rate was due to the continued heavy competition of Phragmites and is below the required success criteria. In response to this problem the infested areas were mowed and teated with herbicide to help control the Phragmites. The planted area at Colington Creek, however has done exceptionally well. The entire planted area has become established predominately with Spartina altemiflora mixed with Juncus roemerianus and Scirpus. One site at Bridge 5 and one site at Bridge 6 were originally identified as containing submerged aquatic vegetation. DCM personnel stated that they did not believe that these areas contained aquatic vegetation. A field visit by DOT staff revealed that the 0.02 acre site at Bridge 5 did not contain aquatic vegetation, and therefore will not require SAV mitigation. However, the canal at Bridge 6 did contain a healthy submerged aquatic vegetation community. 0.27 acres of SAV habitat will be impacted by the filling of this canal. Based on recent discussions with various environmental agencies on the topic of SAV mitigation, NCDOT does not feel that we can offer an acceptable mitigation plan that would allow for in-kind replacement of SAV habitat. The Department also feels that SAV impacts have been avoided and minimized to the maximum extent practicable, while still allowing for the construction of a safe roadway. We will therefore propose to mitigate the 0.27 acres of SAV loss by coordinating with the NC Division of Marine Fisheries to provide for the creation and enhancement of shellfish bed habitat. It is proposed that 0.54 acres of shellfish bed habitat will be created to mitigate for the loss of 0.27 acres of SAV habitat. To mitigate for brackish marsh/wetland scrub associated with both bridges, NCDOT originally proposed creating on- site, in-kind, 0.50 acres of brackish marsh, restoring 0.14 acres of marsh that had been used as a trash dump at the southeast corner of Colington Unity Methodist Church, and by creating 0.75 acres of marsh habitat at an upland site 0.94 miles from the SR 1217/SR 1219 intersection. After consulting with DCM personnel, it was decided to delete from our mitigation proposal the restoration of the 0.14 acre site at the Colington Unity Methodist Church. This acreage was added to the 0.75 acre site. Further review lead to the realization that some wetlands impacts had not been accounted for in our original permit application, and these sites were consequently added to our mitigation plan. The final total acreage value for our proposed off-site mitigation area was 1.31 acres. There was strong environmental agency opposition to our proposal to use the 1.31 acre maritime forest site to create brackish marsh habitat. Based on this opposition, DOT was asked by DCM to abandon our plans for using this site as mitigation. The Department was asked to investigate grading down a line of dredge spoil islands which are adjacent to the canal running south of Bridge 5 (see enclosed photograph). After consultation with NCDOT engineers as to the feasibility of gaining access and grading down these islands, we were informed that the Department does not possess the necessary equipment required to do the work. On January 30, 1992, a meeting was held between North Carolina Department of Transportation and North Carolina Division of Coastal Management personnel. During this meeting, environmental problems associated with NCDOT's permit applications for the above referenced projects were discussed. In an effort to reduce project related wetland impacts, NCDOT agreed to revise the design plans for the two bridges. A redesign of the SR 1217-SR 1219 intersection has reduced impacts to the Juncus marsh by 0.10 acres (0.85 acres brackish marsh vs 0.95 acres brackish marsh impact). This is the maximum impact reduction possible while still ensuring a safe intersection design. The new intersection is depicted on pages 2 of 9 and 3 of 9 in the enclosed revised permit drawings. NCDOT also agreed to reevaluate the need for excavating a new canal to replace the canal which will be filled adjacent to the roadway at Bridge 6. The Department now proposes to delete the excavation of the new canal. This will result in a savings of 0.3 acres of Juncus marsh. Additionally, we were asked to investigate wither or not it would be possible to create Juncus habitat in any area of the canal that would not be filled. We did find that we could create 0.04 acres of Juncus marsh on the west end of the Bridge 6 canal (see enclosed permit drawing 2 of 12). This creation of 0.04 acres is now added to our mitigation propos it . An Equal Opportunity/Affirmative Action Employer J& contacted and asked to provide feasibility and cost estimates for this mitigation effort. We received estimates from 2 contractors. Crofton Diving estimated that the work could be done for $176,000, and Total Marine Services, Inc. estimated it would cost from $90,00 to $110,00 to perform the necessary work. These costs were both deemed to be cost prohibitive for restoring approximately 1 acre of marsh habitat. Extensive searches in the vicinity of the project have not yielded any new mitigation options. NCDOT has requested help from the Division of Coastal Management in locating suitable mitigation sites for this project. DCM personnel have been unable to provide any further mitigation options. Most undeveloped lands in the area which could be used for mitigation posses prohibitive price tags, and the sensitive environmental nature of many of these lands often preclude utilizing these sites for wetlands creation. The revised designs for these projects will lead to a loss of 1.47 acres of brackish marsh/wetland scrub habitat. To mitigate for this loss, it is proposed to create 0.54 acres of brackish marsh habitat on-site. We feel that all reasonable on- or near-site mitigation options have been exhausted. It is therefore proposed that the remaining 0.93 acres of impacted wetlands be mitigated for by debiting this acreage from the NCDOT Company Swamp Mitigation Bank using a 2:1 mitigation ratio. The existing bridge will be completely removed. Any demolition rubble created by the destruction of this structure will not be deposited in wetlands. Planned replacement of the bridge will be accomplished from portable temporary working platforms placed on temporary piles which will negate the use of barges during construction which would require waterway deepening by hydraulic dredging. 6. Bridge No. 5 impacts 1.17 acres of wetlands by encroachment into areas of marsh and wetland scrub habitats. The replacement of 0.50 acres of brackish marsh habitat at Bridge No. 5 will be accomplished in-kind and on-site (see permit drawings 2 of 9, 3 of 9 and 4 of 9). It is proposed to debit the remaining 0.35 acres of brackish marsh and 0.32 acres of wetland scrub impacted by construction of this bridge from the NCDOT Company Swamp Mitigation Bank, using a 2:1 mitigation ratio (1.74 acres total) 7. No mitigation of temporary encroachment into sand bottom areas by pile driving activities is proposed, other than reasonable care to minimize disturbance of bottom sediments, and restriction of pile driving to that area required for construction. 8. Planting for brackish marsh mitigation will consist of WETLAND MITIGATION PLAN REPLACEMENT OF BRIDGE 5 OVER COLINGI'ON CUT sprigging with black needlerush (Juncus roemerianus) on two foot centers over the mitigation areas. Plants will be from nursery stock with some natural revegetation expected to occur. Planting will be carried out between the dates of March 15 and June 15. 9. Fertilization will be in accordance with the project erosion control plan. 10. Mitigation areas of marsh creation will be graded to an approximate elevation of between one and two feet above mean sea level. The final elevation of the mitigation sites will correspond to the elevation in the adjacent marsh. The slope used will be equal to or greater than one-half percent. 11. Field measurements and data collection regarding mitigation success will be carried out by the Roadside Environmental Unit of NCDOT. These data will be transmitted to the Planning and Environmental Branch, and after analysis and consultation, the Planning and Environmental Branch will take the necessary action to further coordinate the results with the Division of Coastal Management, the U.S. Army Corps of Engineers, and other appropriate review agencies. If analysis shows that mitigation success criteria are not being met, corrective actions will ensue from these coordination activities. Field evaluations and subsequent coordination will take place in accordance with the time intervals specified in this monitoring plan. Monitoring will be conducted over a two year period by NCDOT's Roadside Environmental Unit. The mitigation sites will be inspected prior to planting (PP), at planting time (AP), within 1 month after planting (1 MO), 1 year following planting (1 YR) and 2 years following planting (2 YR). Selected data (listed below) will be collected at specified times. During the monitoring interval, remedial action will be considered if needed. NC 27949 WETLAND MITIGATION PLAN NCDOT Project B-2024, Dare County Replacement of Bridge 6 over Colington Creek, SR 1217 June 1, 1992 1. Type of wetlands impacted: Brackish marsh and aquatic bed (SAV) habitat. 2. Acreage of area impacted: 0.30 acres of brackish marsh and 0.27 acres of aquatic bed habitat will be impacted by bridge construction activities. 3. Type of mitigation: Creating on-site, in-kind, 0.04 acres of brackish marsh; Debiting remaining 0.26 acres of brackish marsh loss from NCDOT Company Swamp Mitigation Bank, using a 2:1 mitigation ratio; Creating and enhancing, in coordination with NC Division of Marine Fisheries, 0.54 acres of shellfish bed habitat to mitigate for 0.27 acres SAV impact using a 2:1 ratio. 4. Erosion control of disturbed soils in the area will be adequately mitigated by strict adherence to NCDOT standard erosion control measures during the construction phase of the project. 5. The existing bridge will be completely removed. Any demolition rubble created by the destruction of this structure will not be deposited in wetlands. Planned replacement of the bridge will be accomplished from portable temporary working platforms placed on temporary piles which will negate the use of barges during construction which would require waterway deepening by hydraulic dredging. 7. Bridge No. 6 impacts 0.57 acres of wetlands by encroachment into areas of marsh and SAV habitat. Mitigation for 0.04 acres of brackish marsh impacted by construction of this bridge will be accomplished on-site and in-kind (see sheet 2 of 12). It is proposed that the remaining 0.26 acres of marsh impact be mitigated by debiting from the NCDOT Company Swamp Mitigation Bank, using a 2:1 mitigation ratio (0.52 acres total). To mitigate for SAV habitat impacts, NCDOT proposes to create WETLAND MITIGATION PLAN REPLACMENT OF BRIDGE 6 OVER COLINGTON CREEK and enhance, in coordination with NC Division of Marine Fisheries, 0.54 acres of shellfish bed habitat to mitigate for 0.27 acres SAV impact using a 2:1 ratio. 8. Planting for marsh mitigation will consist of sprigging with black needlerush (Juncus roemerianus) on two foot centers over the mitigation areas. Plants will be from nursery stock with some natural revegetation expected to occur. Planting will be carried out between the dates of March 15 and June 15. 9. Fertilization will be in accordance with the project erosion control plan. 10. Mitigation areas of marsh creation will be graded to an approximate elevation of between one and two feet above mean sea level. The final elevation of the mitigation site will correspond to the elevation in the adjacent marsh of the same species as those to be transplanted. The slope used will be equal to or greater than one-half percent. 11. Field measurements and data collection regarding mitigation success will be carried out by the Roadside Environmental Unit of NCDOT. These data will be transmitted to the Planning and Environmental Branch, and after analysis and consultation, the Planning and Environmental Branch will take the necessary action to further coordinate the results with the Division of Coastal Management, the U.S. Army Corps of Engineers, and other appropriate review agencies. If analysis shows that mitigation success criteria are not being met, corrective actions will ensue from these coordination activities. Field evaluations and subsequent coordination will take place in accordance with the time intervals specified in this monitoring plan. The mitigation sites will be inspected prior to planting (PP), at planting time (AP), within 1 month after planting (1 MO), 1 year following planting (1 YR) and 2 years following planting (2 YR). Selected data (listed below) will be collected at specified times. During the monitoring interval, remedial action will be considered if needed. In this letter., we outlined the difficulties encountered in trying to find suitable mitigation for impacts to 0.93 acres of wetland habitat. With all practicable on-site and near-site mitigation options exhausted, NCDOT proposed mitigating for the 0.93 acres by debiting the Company Swamp Mitigation Bank using a 2:1 mitigation ratio. After discussion with Division of Coastal Management (DCM) personnel, it has been concluded that debiting coastal marsh impacts from Company Swamp Bank is prohibited under provisions of the banking agreement. NCDOT thereby withdraws our proposal to debit Company Swamp Bank. In a final attempt to provide mitigation for the 0.93 acre impact, NCDOT proposes to coordinate with the N.C. Division of Marine Fisheries to provide for the creation and enhancement of shellfish bed habitat using a 2:1 ratio (0.93 acres x 2 = 1.86 acres shellfish bed creation). This effort will be in addition to the shellfish bed enhancement measures proposed for submerged aquatic vegetation impacts. Some juncus was found growing around the outer fringes of site. Due to the phragmites problem the areas have been mowed and treated with herbicide to help control the problem. The planted area at Collington Creek, on the other hand, is doing exceptionally well. The entire planted area has become established ' predominately with Spartina Alterniflora with mixed Juncus Roemerianus and Scirpus. 1 1 2.4 Conclusions There were approximately 1.27 acres of marsh planted on both of these sites. There were no plots established on either site. By visual observation the Collington Cut Site is averaging around 1% aerial coverage of Black Needlerush. This low percentage is due to the heavy competition of phragmites. This is below the success criteria required. However, the Collington Creek Site has established very well over the three year period. HYDROLOGIC MONITORING NCDOT and the Corps agreed wetland mitigation sites must meet the guideline for hydrology (1987 Manual) using consecutive days and not cumulative days of the locally designated growing season. Wetland hydrology criteria in the 1987 Manual notes that a site must be seasonally inundated or saturated (within 12 inches of the surface) greater than 12.5 percent of the local growing season. NCDOT will re-evaluate the 1997 monitoring data to reflect consecutive days rather than cumulative days of the growing season. Regarding monitoring well data, David wants to see compliance is met and that the sites are working. Phil noted that NCDOT is taking a close look at recurring problems associated with monitoring well installation and maintenance. In cases where hydrology was failing for a particular site, NCDOT would be unable to remediate the site until the following year due to seasonal constraints and the necessity to collect specific hydrographic information. In discussing what was considered to be hydrologic success, David Franklin said the 1987 Manual was the official guideline. However, he went on to suggest that the Corps would be interested to see a more detailed breakdown of the well data and would not be opposed to hydrologic success based on a longer monitoring period with less than a 12.5 % success criteria. He also mentioned well data that falls below the 12 inch threshold may also be examined as a special case. Mike Bell suggested site remediation should occur now rather than waiting until December. NCDOT, in coordination with the Corps, will identify unsuccessful sites and work together to determine how the site is failing and the best remediation techniques to implement. VEGETATION MONITORING ISSUES n Due to NCDOT's demand for hardwood seedlings there is a shortage of seedlings this year and there was none available for remediation efforts. There is a minimum one year lead time for ordering seedlings. In a situation on a site where the well data is good but the vegetation is not successful the Corps stated they would review it on a site by site basis. In cases of remediation, Charles said it was almost impossible to grade and plant a site before the winter deadline. Randy Wise requested an extension of the August/September time period to obtain the vegetation monitoring data for the sites. After discussing this issue, it was agreed that the marsh sites would be evaluated in August and the hardwood sites could be evaluated as late as October and November before leaf drop. The NCDOT will send a "blanket" letter to the Corps to modify all permits to reflect the revised vegetation monitoring period. Phil mentioned that although there would be an extension of the monitoring period for vegetation, monitoring reports would continue to be completed and distributed by the end of December. Randy said they often perform random site visits throughout the year to see how vegetation is performing and would perform supplemental planting if noted early enough in the growing season. Ken Jolly asked who was responsible for downloading wells and did they look at vegetation. Beth Smyre said the Geotechnical Unit downloaded well data and notified her of any vegetation issues. The Corps requested that proposed remediation for hydrology and vegetation be included in monitoring reports. NCDOT and the Corps will coordinate any remediation measures. Randy expressed their commitment to remediate vegetation as soon as possible. 7-1 L The discussion turned toward planted versus volunteer species. The Corps does not want to see volunteer species included in survival rate calculations for planted species. Randy noted the survival rate is set at 50% or higher. David wanted to make sure that the sites meet the target species requirement in stems per acre, not a percentage (except for older sites set up for percentage). David also wanted to see the distribution of species planted and volunteer. Randy said it is often difficult to identify certain species during the first two years (several oak species often look alike as saplings). Generally it is easier to differentiate the species by the third year. The Corps wanted to know if there was a way to identify the planted species at planting. However, the planting procedure is 11 0 0 D so labor intensive now it would make it impossible to do so. The 50 foot by 50 foot monitoring plots are chosen and staked in the field after planting has occurred. The Corps wants NCDOT to note the unwanted volunteer species and to identify possible remediation to make sure these species do not dominate the site. The NCDOT and the Corps agreed that the distribution of species is such that no species dominates more than 20 % of the distribution. Red maple and sweet gum are generally not to be planted to insure good numbers of target species. HYDROLOGIC SUCCESS CRITERIA The incorporation of reference systems in determining success was discussed. David concluded that if a particular site failed under the 1987 Manual guidelines, then NCDOT had the option of comparing site parameters to reference site parameters in determining success. The purpose of reference systems was to allow NCDOT a second option in achieving success. The determination of a reference system with its success, criteria would need to be addressed in the mitigation plan. The use of the hydrogeomorphic system (HGM) was also discussed. The Corps is not going to use HGM as a reference system, but will probably look at it as a tool. There are no guidelines out yet on HGM. The use of 20-80 versus 30-70 probability graphs, as defined by WETS. was discussed. These graphs compare the specific year rain data to the historical data for the mitigation site area. The NRCS and WETS use the 30-70 probability graphs and NCDOT would like to use these as well. It was decided to use the 30-70 information and to go to the nearest gage station as long as the source was cited. David determined that if a site's hydrology performs at 12.5%. then hydrologic success has been achieved. If a site performs in the 5% to 12.5% range, then there is "marginal" hydrologic success. If this trend continues, then the entire success criteria for the site will be reviewed. The target percentage for hydrological success should be included in the permit and shown in the mitigation plan. The Corps will be willing to negotiate on the success of the site, but include adequate information in the permit and the mitigation plan. Charles Bruton suggested placing monitoring wells in the impacted wetland areas to assess and compare to mitigation areas. David wanted to insure that the best mitigation site attainable is created. David also asked that well performance be broken out in the report. An interim report was given on Mud Creek. It was noted that wells placed in the reference wetland and wells placed in the created wetland were an inappropriate method to determine hydrologic success because the difference in soil type, hydrology, and cover type. Originally planted in 1995, both sites were designed as mitigation for marsh wetland impacts associated with bridge project B-2024. The Colington Creek site, having been deemed a success, was closed in 1999. Monitoring of the Colington Cut site is presented in this report. ' After five years of monitoring, the Colington Cut site shows by visual observation an aerial coverage of 95% with 90% survival rate, exceeding the minimum 50% area coverage and 50% survival rate. Treatment of the phragmites on the ends of the site ' has worked exceptionally well. Field visits by DCM staff over the past few years have produced questions about whether or not the site has met success criteria. While the site does contain some Juncus roemerianus and Scirpus spp., it appears to be dominated by Phragmites. The 2002 Annual Monitoring Report includes results from the visual vegetation monitoring that took place in October 2002. This report estimates 60% Juncus coverage, 25% Scirpus coverage and 10% coverage of other species. A site visit by two DCM staff members on October 1, 2002 showed the site is dominated by Phragmites. Because the Division does not agree that.the site is dominated by coastal marsh species to an extent greater than 50%, it has been determined that the site has not met the required success criteria. Therefore, additional monitoring and/or remediation will be necessary. In an effort to determine the cause of the lack of success, DCM recommends that the site elevations be compared with other areas dominated by Juncus in that vicinity to determine if the site needs to be regraded. If suitable mitigation can be found nearby or is available at another mitigation site, it may be proposed as replacement for the permitted impacts the Colington Cut site was designed to replace. The sites are located at Bridges No. 5 and No. 6 along SR 1217 in Dare County. It appears, according to the description in your letter, that the vegetation success criteria have been met for the Colington Creek Site (Site 3). We can, therefore, agree with your recommendation to discontinue monitoring at this site. We are pleased at the apparent success this site has shown. Regarding the Colington Cut Sites (Sites 1 and 2), we also agree that monitoring should continue until the success criteria have been met and the Phragmites has been eliminated. The monitoring plan for these sites states as follows: "In the event that these two conditions [plant survival and areal coverage] are not met and environmental restoration is not considered successful, consultation will be held between the staffs of NCDOT's Planning & Environmental Branch and Roadside Environmental Unit, the Division of Coastal Management, the Corps of Engineers, Wilmington District, and federal review agencies."
