PO Box 53587 Fayetteville, NC 28305 Dear Mr. Broadwell: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in an additional 0.9 acres of wetlands or waters for the purpose of constructing lots in Buckhead subdivision in Cumberland County, as you described in your application dated December 2, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is hereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed in all lots with remaining jurisdictional wetlands and waters to restrict future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. A conservation easement shall be placed on at least 4.5 acres of jurisdictional wetlands. Written approval from DWQ is required for the easement. Language for the easement shall be submitted to DWQ by May 23, 1998 for DWQ's written approval. 3. Fill shall be removed from lots 208 and 212. 4. Stormwater shall be directed to sheet flow at non-erosive velocities across remaining wetland areas before entering streams. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R.0500, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H.0506(h). According to 15A NCAC 2H .0506(h), 155 feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not occur. For accounting purposes, this Certification authorizes the fill of 0.9 acres of riparian wetlands in 030615 river and subbasin and 1.0 acres of riparian restoration are required. Please be aware that the wetland Restoration Program (WRP) rules require rounding of acreage amounts to one-quarter acre increments (15A 2R.0503(b)). Division of Water Quality's (NCDWQ) Fayetteville Regional Office and Mr. Eric Fleck from NCDWQ's Central Office met you and your representatives at the above site. As a result of this meeting, it was determined that you have placed fill material in wetlands without prior authorization from the U.S. Army Corps of Engineers (USACOE) or NCDWQ. This material was located at the rear of lots 208-212. As you and your consultant noted, this material will be removed immediately and restored back to original grade. In addition to this unauthorized fill, there was the issue of wetland mitigation on this site as the result of the proposed, additional 0.9 acres of impacts. As was discussed, a prior unauthorized impact of 0.5 acres had occurred in this subdivision and was subsequently mitigated for at a 1:1 ratio (as required by USACOE). After a review of this matter, NCDWQ rules will require that you carry out mitigation for these new impacts unless you can reduce your proposed, additional impacts to < 0.49 acres. Specifically, you will be required to mitigate for a total of 2.3 acres. The 2.3 acres of mitigation was determined by multiplying 1.4 acres of impacts (0S acres + 0.9 acres) by a 2:1 ratio (e.g. 1.4 X 2= 2.8 acres). The 2.8 acres was then reduced by subtracting the prior 0.5 acres of mitigation to yield a total of 2.3 acres. The 2:1 ratio used resulted from the impacts being within 150' to 1000' of a blue line stream as indicated on USGS topographic maps. This mitigation can be accomplished by making a payment to the N.C. Wetland Restoration Program in the amount of $55,200 (e.g., 2.3 acres X $24,000/acre for riparian wetlands = $55,200), or you can (pending NCDWQ approval) carry out 2.3 acres of mitigation elsewhere in the lower Cape Fear River Basin near Fayetteville. If you plan to conduct your own mitigation, the mitigation plan will be subject to NCDWQ approval. Further, you will be required to plant native wetland hardwood trees along the back of lots 208-212 after these disturbed wetlands are restored back to original grade. These plantings must = 320 stems/acre of survival after 5 years, with no species comprising > 20% in occurrence. Species to be planted should include the following: Willow Oak, Swamp Chestnut Oak, Laurel Oak, Overaip Oak, or Water Oak. Please respond to this Notice of Violation within 14 days upon your receipt. Your response should include what measures you plan to implement to rectify this matter. Failure to address the above mentioned violation may result in an enforcement action being pursued against you by one or more of the following agencies: USACOE, NCDWQ, and or USEPA. Scott McLendon and Mike Smith of my staff in the Wilmington District Office. Also present was your consultant, Mr. Robert N. Needham. The purpose of this meeting was to (1), discuss previous filling in the Windtree Subdivision and (2)., discuss your proposed fill of 0.59 acres of jurisdictional wetlands located above the headwaters of Buckhead Creek in the Buckhead subdivision, near the Rockfish and Aberdeen RR, Cumberland County, North Carolina. Based on information provided at this meeting, it was determined that approximately 2.74 acres of fill located at the end of Kinkead Court in the Windtree Subdivision was placed in 1979. In as much as fills located "above the headwaters" were not regulated prior to 1982, this fill is considered grandfathered and not subject to our regulatory authority. With respect to the Buckhead Subdivision, you propose to relocate a previously ditched stream channel and impact approximately 0.5 acres of jurisdictional wetlands on Lot #'s 152, 153, and 154. In addition, you propose to mitigate these adverse impacts on a 1:1 basis by removing historical fill in wetlands on lot #'s 160, 161, and 162. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge does not cause the loss of more than 1 acre of waters of the United States; or b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one but less than 10 acres in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized under paragraph a. above by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. This verification will be valid for two years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the nationwide permit will remain authorized provided the activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization. Navigation. No activity may cause more than a minimal adverse effect on navigation. 2. Proper Maintenance. Any structure or fill authorized shall be properly maintained, including maintenance to ensure public safety. 3. Erosion and Siltation Controls. Appropriate erosion and siltation controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills must be permanently stabilized at the earliest practicable date. 4. Aquatic Life Movements. No activity may substantially disrupt the movement of those species of aquatic life indigenous to the waterbody,. including.those species which normally migrate through the area,-unless the activity's primary purpose is•to impound water.. 5. Equipment. Heavy equipment working in wetlands must be placed on mats or other measures must be taken to.minimize soil disturbance. 6. Regional and Case-by-case Conditions. The activity mast comply with any regional conditions which may have been added by the Division Engineer and any case specific conditions added by the Corps. 7. Wild and Scenic Rivers. No activity may occur in a component of the National Wild and Scenic River System; or in a river officially designated by Congress'as a "study river" for possible -inclusion in the system, while-the river is in an official study status. Information on Wild and Scenic Rivers may be obtained from the National Park Service and the U.S. Forest Service. 8. Tribal Rights. No activity or its operation may impair reserved tribal, rights, including, but not limited to, reserved water rights and treaty fishing and hunting•rights. , 9. Water Quality Certification. In certain states, an individual state water quality certification must be obtained or waived. 10. Coastal Zone Management. In certain states, an individual state coastal zone management consistency concurrence must be obtained or waived. 11. Endangered Species. No activity is authorized under any NWP which is likely to jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act, or which is likely to destroy or adversely modify the critical habitat of such species. Non-Federal permittees shall ngtify the District Engineer if any listed species or critical habitat might be affected or is in the vicinity of the project and shall not begin work on the activity until notified by the District Engineer that the requirements of CL7-GCWN i -2- the Endangered Species Act have been satisfied and that the activity is authorized. Information on the location of threatened and endangered 'species can be obtained from the U.S. Fish and Wildlife Service and National Marine Fisheries Service. 12. Historic Properties. No activity which may affect Historic Properties listed, or eligible for listing, in the National Register of Historic Places is authorized, until the District'Engineer has complied with the provisions of 33 CFR 325, Appendix C. The prospective permittee must notify the District Engineer if the authorized activity may affect any historic properties listed, determined to be eligible, or which the prospective permittee has reason to believe may be eligible for listing on the National Register of Historic Places, and shall not begin the activity until notified by the District'. Engineer that the requirements of the National Historic Preservation Act-have been satisfied and that the activity is authorized.' Information on the location and existence of historic resources can be obtained from the State Historic Preservation Office and the National Register of Historic Places (see 33 CFR 330.4(8)). - 13.. Notification. a. Where required.by the terms of the NWP, the prospective permittee must notify the District Engineer as early, as possible and shall not begin the activity: (1) until notified by the District Engineer that the activity may proceed under the NWP with any special conditions imposed by the District or Division Engineer; or (2) if notified by the District or Division Engineer that an individual permit is required; or - (3) Unless 30 days have passed from the District Engineer's receipt of the notification and the prospective permittee has not received notice from the District or Division Engineer. Subsequently, the permittee's right to proceed under the NWP may be modified', suspended or revoked only in accordance with the procedure set forth in 33 CFR 330.5(d)(2). b. The notification must be in writing and include the following information and any required fees: (1) Name, address and telephone number of the prospective permittee; (2) Location of the proposed project; 1 (3) Brief-description of the proposed project; the project's purpose; direct and indirect adverse environmental effects the project would cause; any -3- other NWP(s), regional general permit(s) or individual permit(s) used or intended to be used to authorize any part of the proposed project or related activity; (4) Where required by the terms of the NWP, a delineation of affected special aquatic sites, including wetlands; and (5) A statement that the prospective permittee has contacted; (a) The USFWS/NMFS regarding the presence of any Federally listed (or proposed for listing) endangered or threatened species- or critical habitat in the permit area. that may be affected by the proposed project; and any available information provided by those agencies. (The prospective permittee may contact Corps District Offices for USFWS/NMFS agency contacts and list of critical habitat.)' (b). The SHPO regarding the presence of any. historic properties in the permit area that may be affected by the proposed project; and the available information, if any provided by that agency. 14. Water Supply Intakes. No discharge of dredged or fill material may occur in the proximity of a public water supply intake except where the discharge is repair of the public water supply intake structures or adjacent bank stabilization. 15. Shellfish Production. No discharge of dredged or fill material may occur in areas of concentrated shellfish production, unless the discharge is directly related to a•shellfish harvest activity authorized by nationwide permit. 16. Suitable Material. No discharge of dredged or fill material may consist of unsuitable material (e.g., trash, debris, car bodies, etc.) and material discharged must be free from toxic pollutants in toxic amounts. 17. Mitigation. Discharges of dredged or fill material into•waters of the United States must be minimized or avoided to the maximum extent practicable at the project site (i.e., on-site), unless the District Engineer has approved a compensation mitigation plan for the specific regulated activity. 18. Spawning Areas. Discharges in spawning areas during spawning seasons must be avoided to the maximum extent practicable. 19. Obstructions of High Flows. To the maximum extent practicable, discharges must not permanently restrict or impede the passage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of the fill is to impound waters). 20. Adverse Impacts from Impoundments. If the discharge creates an impoundment of water, adverse impacts on the aquatic system caused by the accelerated passage of water and/or the restriction of its flow shall be minimized to the maximum extent practicable. 21. Waterfowl Breeding Areas. Discharges into breeding areas for migratory waterfowl must be avoided to the maximum extent practicable. 22. Removal of Temporary Fills. Any temporary fills must be removed in their entirety and the affected areas returned to their preexisting elevation. k r NATIONWIDE CONDITIONS a. The discharge does not cause the loss of more than 10 acres of waters of the U.S. For the purpose of this nationwide permit, the acreage of loss of waters of the U.S. includes the filled area plus waters of the U.S. that are adversely affected by flooding, excavation, or drainage as a result of the project. - b. A 30-day notification to the District Engineer (DE) is required if the, discharge would cause the loss of water of the U.S. greater than one acre. For discharges in special aquatic sites, including wetlands, the notification must include a delineation of affected special aquatic sites including wetlands. C. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. STATE CONSISTENCY CONDITIONS - a. All fill material authorized by this permit must be obtained from an upland source. b. Use of this nationwide permit for waste disposal facilities is not authorized. c. If the proposed activity is within the North Carolina Coastal Area and the activity will result in the loss of waters of the United.States greater .than 1/3 of an acre, the applicant must receive written concurrence from the North Carolina Division of Coastal Management (NCDCM) that the.aetivity is consistent with the North Carolina Coastal Management Program. d. Should all or part of a proposed activity be located-within an Area of Environmental Concern (AEC) as designated by the North Carolina Coastal Resources Commission, a Coastal Area Management Act (CAMA) permit is required from the North Carolina Division of Coastal Management (NCDCM). Should an activity within or potentially affecting an AEC'be proposed by a Federal • ' agency, a consistency determination pursuant to 15 CFR 930 must be provided to the NCDCM at least 90 days before the onset of the proposed activity. GENERAL CERTIFICATION CONDITIONS a. General Certification is denied for fills greater than one area in SA, trout, HQW, ORW, WS-I and WS-II watersheds. General certification is issued for all other waters for fills of not more than 10 acres and in those watersheds specified above for fills of not more that one acre. b. '*Proposed fill or substantial modification of greater than one-third of an acre of such waters, including wetlands, requires a written concurrence from the Vorth Carolina Division of Environmental Management (NCDEM). -2- e. Established sediment and erosion control practices will be utilized to prevent violations of the appropriate turbidity water quality standard (50 NTU's in streams and rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's in all saltwater classes and all lakes and reservoirs and 10 NTU's in trout waters). d. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the State until the concrete has hardened. e. Additional site-specific conditions may be added to this Certification in order to ensure compliance with all applicable water quality and effluent standards. f. Concurrence from the North Carolina Division of Environmental Management (NCDEM) that this Certification applies to an in project shall expire three years from the date of the cover letter from the NCDEM. Specifically, you will be required to mitigate for a total of 1.8 acres. The 1.8 acres of mitigation was determined by multiplying 0.9 acres of new impacts by a 2:1 ratio (e.g. 0.9 X 2= 1.8 acres). The 2:1 ratio resulted from the impacts being within 150' to 1000' of a blue line stream as indiat?d on USGS topographic maps. The OS acres of mitigation that was completed on the site was done for the ITS. Army Corps ofrnginccrs and is therefore not relevant in NCDWQ's calculations. Eric Fleck and I met with Messrs. Dohn Broadwell Sr. and Jr., Bud Needham, and a few other interested parties 2/6/98. Maybe I understand their angle now, but I'm still not sure I buy it. Depending on how you interpret the cumulative impact issue that Eric is to explain to you, my regional office recommendation is one of the following: 1) If you think that they are still to be held accountable for the previously disturbed and "mitigated for" one-half acre in the earlier sections, then they should obviously be required to avoid/minimize, etc. and mitigate for riparian wetlands at the appropriate ratio. Taking the old fill into account, the total project fill would now be 1.4 acre. (Or is it 1.55, given the 401 Certification for .65 ac. dated 10/4/93?) The old fill mitigation appears to have included removal of some fill and creation of a new channel adjacent to the railroad ditch. 2) If you are of the opinion that they are not accountable for any of the previous fill (including the .15 acre difference), since it was mitigated for and can't be considered as cumulative impacts, then we can't really say too much. I feel sure that there is not ?1/3 ac. impact within 50 feet of the stream in the area depicted in the application. However, much of the violation which Eric F. will explain is either adjacent or very close to the run of the stream. This violation area is supposed to be restored to original grade etc. after the building lots are filled. A restoration plan should be required for this area as a condition of any approval or certification, regardless of how this ends up. This should include restoration of what appears to be a large sediment basin in the wetland. Itemized response to the triage inquiry: This is a perennial stream with a fairly well defined channel in most places. Most of the impacts in the application are greater than 50 feet from the mean high water mark of the stream. This does not include the impacts of the current violation. Minimization/avoidance options are slim, given the setback requirements and shallow depth of high ground. Mitigation for current application would be for impacts >50 ft. and <150 ft. from the stream. As far as cumulative impact concerns go, I have some difficulty with the idea of ignoring the past fill and mitigation scenario, even though it appears that they satisfied the COE and successfully (?) expanded an existing marsh-like habitat. This is the last phase of the development, and it essentially gives them a "free" nine-tenths acre in a valuable wetland location rather than mitigation for 1.4 (or 1.55) acres. This 100% urban watershed continues to be developed and receives a considerable amount of runoff, much of it from commercial parking lots. The consultant for Mr. Broadwell, Mr. Bud Needham, called several weeks prior to my receiving the application to explain that cumulative impacts were not a problem on this site. If I remember correctly, Bud said the property involved in Buckhead Section 6 belonged to another individual (not Dohn Broadwell) who was interested in adding it in as part of the existing Buckhead subdivision, which already has a history of wetland fill. Bud apparently was trying to explain the reasons why cumulative impacts would not be a concern. That whole issue is debatable. Aside from the issue of cumulative impacts, this work has essentially been done, for the most part. All of the fill site clearing appears to have been completed and a considerable amount of fill material is on site awaiting placement. I will probably recommend denial of at least part of this application, not to mention the prospects for mitigation if the cumulative impacts are assessed. The purpose of this memo is to let you and the staff know that this project has not been forgotten, along with several others I'm far behind on. Eric Fleck, (at my request) has kindly agreed to visit this site and commence a letter writing campaign to Mr. Broadwell. I have photographs of the site and will make these available.
