401 Water Quality Certification Application

Dear Ms. `Ebert:
The Division of Water Quality is in receipt of your application for a 401 Water Quality
Certification. This application contains contradictory information regarding the length of stream to be
placed in culverts. On page 3, (question #10 b) the application indicates that 130' of stream is to be placed
in culvert. However, the site plan indicates 70' of stream to be placed in three 78" CMP culverts and that an
additional 264' of stream is to be placed in a single 48" RCP culvert. According to this site plan, there is a
total of 334' of culvert requested for this project.
As a result, the Division of Water Quality is placing this project on indefinite hold until an
application addressing these aforementioned inconsistencies is submitted. If you should have any questions

impacts are documented. This Office has already documented a stream standard violation as the result of the
stream impacts at this site. The violation was for exceeding the turbidity standard as the direct result of a crane
digging in the stream bed. The Division of Land Quality found that proper BMPs were not in place at the time of
the documented violation.
