Preston Howard, Jr., P.E., Director NCDENR NORTH CARouNA DEPARTMENT OF ENVIRONMENT ANo NATURAL RESOURCES March 12,1998 Wake County WQC 401 Project #970693 APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules Mr. Michael Whitehead 502 East Lockmere Drive Cary NC 27511 Dear Mr. Whitehead: You have our approval, in accordance with the attached conditions, to place fill material in 0.415 acres of wetlands or waters for the purpose of constructing utility and road crossings and lot fill at Willow Creek development, as you described in your application dated July 24, 1997. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3101, 3103, and 3108. These Certifications allow you to use Nationwide Permit Numbers 12,14, and 26 when the Corps of Engineers issues them. Ibis approval is also valid for the Neuse River buffer rules (15A NCAC 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be, required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Wake County NEUSE RIVER BASIN The proposed impacts associated with this site ' cludes 437 linear feet of first and second order channel impacts. The cha are manmade, historic installedto expedite the draina a of water from th drairj. The stream channel starting approximately at the location noted on t -e attached map. That is, this is where the drain begins to take on characteristics of a stream. This stream broads out into intermittently inundated depression located in the drain (caused by a road crossing). The RRO does not recommend stream mitigation for the channel impacts - see map. Also, it is the RRO's opinion that these channels not fall within the intent of the the 7 Riparian Buffer Rules except for the 200 feet indicated on the map. Acer rubrum , Nyssa sylvatica, Liquidambar styraciflua, Arundinaria gigantea were prominent in this depression located in a Sandhiils drain. Recommendation: Issuance of the Certification with the condition that the site indicated as #1 be avoided. That is, the attached map does not comply with the NW12 general conditions. Attached is a copy of your response to the permit application which states two concerns associated with an area referred to in your letter as the central channel. Specifically, you indicated concern over the potential application of the Neuse Basin Rules (NBR's) and a potentially unnecessary channel impact resulting from the construction of a utility line. Note that on our 11-5-97 site meeting, we confirmed that this area does not meet the NBR's intermittent channel criteria. The only questionable feature was declared to be an excavated ditch that is not connected to Waters of the US. We therefore request that you declare the area exempt of the NBR's and approve the proposed location of the utility line. Please call if you have any questions. Spocitfxcally, you indicated concern over the potential application of the Neuse Basin Rules (NBR's) and a potentially unnecessary channel impact regulting from the construction of a utility line. On November 5, 1997 you, Danny Smith, Steve Roberts and I met on-site to discuss 401 and Neuse Basin Buffer (NBR) concerns for Phase I and II of this project. The consensus of the meeting was that there were no streams within these phases subject to the NBR buffers except the one at the far north eastern edge of the tract adjacent to Highway 55. No proposed lots or other land disturbing activities were proposed within 50' of this stream,. Also, after examining proposed wetland i'rnpacts for these phases, we were informed that you had no problem with issuing a 401 for the proposed impacts. Based on this site meeting, we advised the client on November 6, 1997 that these two phases were acceptable as proposed and that he could move forward with the project as planned. We also advised him of the buffer requirement for the stream adjacent to Highway 55.
