Jordan Lake Riparian Buffer Major Variance
MVP Southgate
Dear Mr. Raffenberg:
On February 8, 2019, the Division of Water Resources (Division) received your application dated
February 8, 2019, requesting a Major Variance to the Jordan Lake Riparian Rules for the subject
project.
On March 15, 2019, the Federal Energy Regulatory Commission (FERC) provided notice of the
schedule for environmental review of the subject project. In the notice, FERC states that the
draft EIS will be issued in July 2019. Based on the response provided to the Division for the 401
water quality certification and riparian buffer authorization application, and follow up phone
conversations with MVP contacts, updated impact tables, final plan and profile views for
proposed impacts will not be available until after July 2019.
This application is considered incomplete and is on hold until the draft EIS is issued with the
preferred route identified and Mountain Valley has provided updated impact information to
the Division for review.
Please note that if the Division determines to hold a public hearing or hearings on the 401
water quality certification application, the Major Variance request will not be presented to the
Environmental Management Commission (EMC) until after the hearing(s) occur. The EMC has
also requested the Division present an information item to the Water Quality Committee of the
EMC prior to bringing the request for final action.

Please be aware that you have no authorization under Section 401 of the Clean Water Act or
the Jordan Lake Riparian Buffer Rules for this activity and any work done within waters of the
state or riparian buffers may be a violation of North Carolina General Statutes and
Administrative Code.
