This review will likely require an on-site inspection prior to the approval, modification or denial of your project site. If you have sent additional information to the U.S. Army Corps of Engineers concerning this project, please be certain that our staff have copies of this material so we can use it in our process in making a decision. According to our preliminary, in-house review since you propose to disturb greater than 150 feet of streams of wetlands, it is likely that compensatory mitigation will be required by DWQ for this project as described in 15A NCAC 2H .0506 (h). Our Regional Office staff can make this decision during their site visit. If adequate mitigation is required but not provided, this project will likely have to be denied. Also if a mitigation plan is required, we will place this project on hold until its receipt in our Central Office. Enclosed are materials describing compensatory mitigation requirements for this program. Please call me at 919-733-1786 to discuss these matters if necessary. Until a mitigation plan is provided, this application is considered to be incomplete and our processing time will not start. Project G-1519 Dear Mr. Tilghman: Engineering Consulting Services, Ltd. (ECS, Ltd.) has completed the wetland delineation services for the above referenced site. The site consists of five residential lots located on Bryson Bend Drive in Charlotte, North Carolina. A tributary of Sixmile Creek is located at the rear of the lots. We understand that Centex Homes wishes to relocate the tributary prior to grading the lots. ECS, Ltd. visited the site on April 16, 1997 to identify and delineate wetlands and jurisdictional waters located on the property. Approximately 350 linear feet of a tributary of Sixmile Creek crosses the site. The center line of the creek was marked in the field with surveyor's tape. The flood plain adjoining the creek was inspected for the presence of wetlands. In order for an area to be classified as a wetland, hydrophytic vegetation, hydric soils, and wetland hydrology indicators must be present. Wetlands were not observed at the site. A copy of the routine wetland data form prepared for the site is attached. An application must be made to the North Carolina Division of Water Quality (NCDWQ) and the United States Army Corps of Engineers (USACE) prior to impacting more than 150 linear feet of stream bed. We recommend that a Pre-Construction Notification (PCN) Application be submitted to the NCDWQ and USACE (Asheville Regulatory Field Office) prior to initiating grading activities at the site. Dccd rosuictlous should be placed on the mitigation site to prevent future impacts by current or future owners. The relocated stream and riparian zone should be planted with a mixture of native treas'and shrubs suitable for floodplains. For the stream bank, species (e.g., sycamore, river birch, black willow and silky dogwood) that arc fall growing and provide bank stability should be chosen. For the remainder of the riparian area, mast producing species (e.g., swamp chestnut oak, black gum and Shumard's oak) that will provide benefits to wildlife are recommended. Approximately 350 linear feet of a tributary of Sixmile Creek crosses the site. The center line of the creek was marked in the field with surveyor's tape. The flood plain adjoining the creek was inspected for the presence of wetlands. In order for an area to be classified as a wetland, hydrophytic vegetation, hydric soils, and wetland hydrology indicators must be present. Wetlands were not observed at the site. A copy of the routine wetland data form prepared for the site is attached. An application must be made to the North Carolina Division of Water Quality (NCDWQ) and the United States Army Corps of Engineers (USACE) prior to impacting more than 150 linear feet of stream bed. We recommend that a Pre-Construction Notification (PCN) Application be submitted to the NCDWQ and USACE (Asheville Regulatory Field Office) prior to initiating grading activities at the site. The applicant wants to relocate the existing stream channel prior to lot grading. The existing channel is proposed to be relocated to the property line at the rear of each lot. The primary concern of this office is the negative effect such a relocation will have on downstream portions of the UT. Channelization (straightening) of the UT will most likely prove to be detrimental to the downstream portion of the UT as a result of increases in stormwater velocity. The potential for instream scouring and excellerated bank erosion will increase, especially since the UT will most likely carry additional stormwater once the development is completed and impervious surfaces are common throughout the surrounding area. Furthermore, vegetative losses during site grading and stream bank disturbance will also have a negative effect on stream temperature (will potentially increase). Ellington Park 401 Page Two In a phone conversation with the applicant (Mr. Randol Tilghman) the above concerns regarding stormwater flows and the potential for instream degradation were expressed by the writer. As an alternative, the writer suggested the company replace (as much as possible) the current UT's travel patterns as well as the existing vegetative buffering in relocating the UT. Mr. Tilghman indicated that his company would be willing (within reasonable constraints) to replacing the natural twists and bends of the existing UT, include various flow reduction devices, as well as utilize natural stream bank stabilization practices (bioengineering) that will eventually replace vegetative losses. The site consists of five residential lots located on Bryson Bend Drive in Charlotte, North Carolina. A tributary of Sixmile Creek is located at the rear of the lots. We understand that Centex Homes wishes to relocate the tributary prior to grading the lots. ECS, Ltd. visited the site on April 16, 1997 to identify and delineate wetlands and jurisdictional waters located on the property. Approximately 350 linear feet of a tributary of Sixmile Creek crosses the site. The center line of the creek was marked in the field with surveyor's tape. The flood plain adjoining the creek was inspected for the presence of wetlands. In order for an area to be classified as a wetland, hydrophytic vegetation, hydric soils, and wetland hydrology indicators must be present. Wetlands were not observed at the site. A copy of the routine wetland data form prepared for the site is attached. An application must be made to the North Carolina Division of Water Quality (NCDWQ) and the United States Army Corps of Engineers (USACE) prior to impacting more than 150 linear feet of stream bed. We recommend that a Pre-Construction Notification (PCN) Application be submitted to the NCDWQ and USACE (Asheville Regulatory Field Office) prior to initiating grading activities at the site.
