Please reference the Department of the Army November 22, 2011 permit authorizing the
permanent impact to 14,1551f of stream channel and 7.64 acres of wedand and the temporary
impact to 1,0351f of stream channel and 0.05 acres of wetlands for the North Charlotte Outer
Loop (I-485, R-2248 E) and the I-485/I-85 interchange modification (R-2123 CE) in
Mecklenburg and Cabarrus Counties, North Cazolina. Please addidonally reference your
Mazch 22, 20131etter requesting modificarion to the pernut resulting from changes to the project
plans. The permit modification request the overall decrease of permanent stream impacts by 372
lf, decrease in siream bank stabilization by 831f, decrease in temporary stream impact by OAl
acre (-1621 fl and the overall increase in wetland impact of 1.017 acre (with 0.5 acres of previous
hand clearing (Site 12) that will now be part of the permanently maintained right of way so is
considered a wetland conversion and is now a mitigable unpact).1'he change in these impacts
result in the reduction of required mitigation by 3721f of streaxn channel, an increase of 138
acres of riparian wedand (increase in 0.897 acres of riparian impact plus previous 0.5 acre of
impact that will now be permanenfly maintained and requires mitigation) and an increase of 0.12
acres of non-riparian wetlands.
The pernut modification further identifies an error with previous mitigation calculations. The
permit issued 11/22/2011 required mitigation via payment to DMS (formerly identified as EEP)
at an amount sufficient to provide for 16.44 riparian wetland credit in the Yadkin River Basin.
Based on file review, the correct amount should have been 14.02 riparian wetland credits. The
table below shows all impacts and required mitigation, and conections from the 11/22/2011
issued permit:

* Error in calculation believed to been caused by calculating the 0.79 acre riparian wetland impact
(R2123 CE Yadkin basin) at a 4:1 ratio and erroneously adding in the 0.84 acre non-riparian impact
(R2123 CE I'adkin).
** Corrected mitigation that should have been required based on a 2:1 ratio for riparian wetland
impacts.
I.n regards to mitigation, the pernut modification additionally states that DMS had concerns
regarding the mitigation condition which states "EEP will provide ....0.84 acres equivalent non-
riparian wetlands..." DMS provided a letter dated Apri121, 2011 indicating that "...non-riparian
wetland impacts located in the mountains and piedmont areas of North Carolina will be accepted
as requested but mitigated utilizing riparian wetland mitigation credits." This requirement is due
to the difficulty of finding non-riparian wetland in the piedmont. DMS requested that the
mitigation condition be changed to remove the requirement for providing the "equivalent non-
riparian wetlands."� �This change is reflected in the updated mitigation condition shown below.

R-2123 CE — Interchange Portion with I-85 and Future I-485
Minor changes to work in uplands that do not affect pernutted impacts are proposed for this
section. These minor changes include revised draining over a utility culvert on Plan Sheet 8,
Ramp B and shoulder drains were added on Sheet 10.
R-2248E — Roadway Portion of Future I-485 between I-85 and NC 115
Site 5(Stream S6): Changes due to minor grade, fill slope and alignment changes which
were necessary to accommodate the approach to the new bridge over Stream S7 resulting in the
lengthening and shift slightly to the south of the 8'x7x RCBC.�
Site 6(Stream S7): Dual bridges will be constructed to cross the area including Stream S7
resulting of the elimination of 9'x7' RCBC.
Site 8(Stream Sll): Vertical roadway profile for Service Road A was lowered and the 8'x9'
RCBC was shortened to reduce impact and construction costs.. _
Site 9(Stream S15): Vertical profile for Service Road A lowered and the 42" RCP was
shortened to reduce impacts and construction costs. •
Site 12 (Wetlands WBA, W109 and Stream Sll): A new sewer line will cross portions of
WBA and S 11. The sewer line crossing of S 11 will be via directional bore and therefore will not
impact S 11. Wetland impacts are due to increased excavation due to removal of the old sewer
line under the new bridge as well as removal of two manholes within the wetland.
Site 13 (Wetlands WL, WO and WP): A new water line will impact wetland WO.
Site 14 (Wetland WQ): The existing corrugated steel arch pipe remained in place and the
construction of the double 7'x8' RCBC at S11/Mallard Creek Road was eliminated.

entire area will be now be maintained as right of way and therefore will now require mitigation.

After review of the file and the modification request we have determined that the proposed
changes to the permit are minor, and that a supplemental public notice is not necessary. It should
be noted that this modification request was received by our office on March 22, 2013. Although
the project was reviewed and given verbal authorization at that time formal authorization was not
provided and the project modification work has since been completed. This letter provides
formal authorization, after-the-fact for the project modifications and accordingly your pernut is
hereby modified and a copy of the modified plans are enclosed.
The total impacts authorized by the original November 22, 2011 permit and this
modification include the permanent impact to 13,7001inear feet of stream channel and 8.56
acres of wetlands and the temporary impact to 8731f of stream channel and 0.05 acres of
wetlands.

The total revised mitigation requirement for the November 22, 2011 permit and this
modification includes payment to DMS in an amount sufficient to provide credits for
24,134 stream credit,16.78 riparian wetland credit and 1.08 non-riparian wetland credit iu
the Yadkin River Basin (03040105) and for 1,102 stream credit and 0.34 wetland credit in
the Catawba River Basin (03050101).
In consideration to the changes in mitigation requirements, Special Condition "w" for
Mitigation is hereby modified as follows:
w) In order to compensate for impacts associated with this permit, mitigation shall be
provided in accordance with the provisions outlined on the most recent version of the
attached Compensatory Mitigation Responsibility Transfer Form. The requirements of
this form, including any special conditions listed on this form, are hereby incorporated
as special conditions of this permit authorization.
