Atlantic Coast Pipeline (ACP) Comments on 401 Certification in North Carolina (NC) 3. The NC ACP DEQ 401 Certification Permit must consider worse case scenarios and cumulative impacts. DE will own the ACP the easements across private lands forever. It is possible that DE/Dominion could do the following with “their” easements. 1. Add a second pipeline parallel to the first one. 2. Add a second or third compressor station along the ACP route in NC. 3. Use the pipeline to carry radioactive wastes, oil, gasoline etc. 4. Ask for a waiver to increase the gas pressure in the pipeline above the current maximum allowable operating pressure of 1440 psi. 5. Apply herbicides to a 75 foot gas company right of way along the pipeline to prevent tree growth. 6. Build lateral pipelines off the ACP. Some of these will cause increased disturbance of land and waters and wetlands. Some will impact toxicity or increase safety risks and also would have negative consequences for the soil, water, wetlands, farm fields, human health etc. In some cases more land would be condemned by DE. These items also define the project you must consider for the 401 Certification permit for the ACP. 1
