As Land Management Group explains in their August 26, 2004 letter,
Figure 8 Yacht Club applied for a CAMA Major Permit to expand the
existing marina by 10 slips in April 2004. Figure 8 Yacht Club is
located in waters classified SA ORW. The Water Quality Standards that
apply to ORW waters are very specific depending on what ORW area the
project is located in. The following are comments I entered at the
time I reviewed the CAMA application:
This office objects to the proposed expansion of the Figure Eight
Island Marina. The construction of additional boat slips would be a
violation of Administrative Code Section:15A NCAC 2B .0225 (e)(7)(F).
This code states that in the Topsail Sound and Middle Sound Area
including all estuarine waters from New Topsail Inlet to Mason Inlet,
the only type of new or expanded marina that shall be allowed shall be
those marinas located in upland basin areas or those with less than 10
slips, having no boats over 21 feet in length and no boats with heads.
This office recommends that the proposed project be denied.
My position stands. Other projects in ORW areas have been unable to I
expand or construct the number of slips desired for the same reason.
Land Management Group makes the point that a shellfish closure will not
occur as a result of the expansion. This is a positive aspect of the
project, however, our ORW rules concerning new and expanded marinas do
not say that it is allowable if a shellfish closure does not occur. It

simply says that it is not allowable. Boats are a source of pollutants
beyond the fecal coliform concern. Gas, oil, and gray water also
contribute to degradation of water quality (I am a boat owner: I know.)
Land Management also mentions a minor modification that CAMA issued in
2003 for additional floating docks. DWQ does not have the opportunity
to review minor modifications and DCM should not issue minor
modifications for new or expanded marinas in ORW areas w/o DWQ's
approval.
You also commented on the expansion on the DCM memo. I received a
copy. You basically said the exact same thing that I did, including
the fact that expansion of the marina would be a violation of water
quality standards and DCM should deny. I can fax you a copy if you do
not have one available.
Figure 8 Yacht Club should seek a variance if they wish to expand, but
note that the Wilmington Regional Office does not support the granting
of a variance.

Dear John,
As discussed by phone recently, the Figure Eight Island`Yacht Club applied for additional
boat slips at their existing marina in April 2003. During review, it was determined by
DCM that there are currently a total of 90 boat slips present at the marina. The, intent of
the applicant is to'bring the number of slips up to 100, which matches the total allowed
within the existing shellfish closure area established by the *Shellfish Sanitation Office.
The application review is currently on a voluntary hold in order to resolve any remaining
issues relating to the additional slips. The agency comment letters (from the Corps,
USFWS, NMFS and DCM) in the CAMA application file all related to limiting the total
number of slips to 100. The applicant intends to revise the plan drawings and amend the
application information to reflect that number. In discussions with Noelle Lutheran, it is
her opinion that no additional slips can be authorized under DWQ rules (T15A: 02B
.0225) based on the ORW classification of this area. However, according to the DCM
field report issued 4/30/03, a renewal/minor modification of CAMA Permit #48-91 was
issued on 2/20/96 allowing the addition of seven floating docks to the marina. This
permitting action post-dated an earlier version of the same rules. The rules at that time
covering the Middle Sound ORW area were identical to today's rules with the exception
of the number of slips. (The earlier version referenced "less than 30 slips", and the current
version references "less than 10 slips".)
The primary water quality concern in this area relates to the harvesting of shellfish for,,.
human consumption and the potential for overboard discharge from boat heads. The
existing closure area imposed'by the Shellfish Sainitatiori Office already covers.- up to 100"*-.

DWQ staff have reviewed the plans to expand an existing pier by adding a floating dock and six finger docks to the
Figure Eight Island Yacht Club Basin located in New Hanover County. DWQ believes that this project as proposed will
result in closure of open SA waters. DWQ recommends that the project be reduced in scope to the size at which closure will
not occur. Otherwise, DWQ has determined that there will be a violation of water quality standards with the presently
proposed project and recommends that DCM deny the CAMA permit accordingly.

9. PROJECT DESCRIPTION
The project site is located at 15 Bridge Road on the west side of Figure Eight Island, between Mason's Inlet and
Rich's Inlet, on a canal that intersects the Atlantic Intracoastal Waterway (AIWW), in Middle Sound, New
Hanover Co. The twenty four (24) acre tract runs from the Figure Eight causeway bridge, east to Beach Road
South. Existing structures and/or features located on the tract include: a two-story community clubhouse and
marina, a swimming pool, parking lot, access road and existing eighty-eight (88) slip docking facility. The total
square footage of existing floating dockage at the project site equals approximately 12,344 sq. ft. The elevation
of the site ranges from 8-10 feet above mean sea level. Live Oak and Red Cedar are the predominant species in
located in the uplands along with landscape vegetation. Under-story shrub vegetation is dominated by Wax
Myrtle (Myrica cerifera), Marsh-elder (Iva fiutescens), and Grounsel-bush (Baccharus halimifolia). On the
property's northern shoreline, there is a border of coastal wetlands, approximately 10-50 feet in width from the
bulkhead waterward. Smooth Cordgrass (Spartina alterniflora) is the predominant species found along the
waterward side of the marsh border. The slightly higher elevation of the marsh also contains Smooth Cordgrass
(Spartina alterniflora), intermixed with Spike Grass (Distichlis spicata), Sea Lavender (Limonium, spp.),
Glasswort (Salicornia, spp.), and Sea-Oxeye (Borrichia frutescens). Salt Meadow Grass (Spartina patens),
Marsh-elder (Iva frutescens) and Grounsel-bush (Baccharus halimifolia) complete the transition to highground.
Figure Eight Island Marina was originally permitted in 1978 (LAMA Permit# 170) for the construction of a 68
unit condominium complex and associated boating docks On February 14, 1980 the permit was modified to
expand the existing condominium complex by adding twenty- four (24) additional units and twenty-four (24)
additional boat slips to the marina. On March 30, 1983, a one year renewal was issued to the permittee for
completion of the docking facility at the marina. The permit renewal expired on December 31, 1983 before the
dock project was complete. No condominium units were ever constructed at the site.
On April 24, 1986 a new permit, CAMA Permit# 72-86, was issued to the permittee for the reconfiguration and
reconstruction of floating dockage at the marina, allowing thirteen (13) new docks. On July 17, 1987, a major
modification of permit 72-86 was granted for the construction of thirty-one (31) additional docks, bringing the
total number of floating docks to forty-four (44). Permit 72-86 expired in 1990 and was never renewed.
However, a new permit (CAMA Permit# 48-91) was issued in 1991 to cover the dock reconfiguration project.
Permit number 48-91 was issued to Figure Eight Island Yacht Club, Inc. on March 27,1991 for the
reconfiguration of floating docks at the marina. The total number of docks were to remain the same (44)
however, the orientation of the docks were to be rearranged.
Although Figure Eight Island Yacht Club, Inc. was previously permitted to construct forty-four (44) docks, or
eighty-eight (88) slips, the permittee only constructed forty-one (41) docks from the date of the original permit
date in 1978 to the first renewal of the second permit (48-91) issued on January 5, 1995.
On January 5, 1995, Figure Eight Yacht Club, Inc. renewed permit 48-91 for the construction of a 420' bulkhead
along the northern portion of the property. No construction or dock configuration was made during the renewal
period.
On February 20, 1996 a 2 °d renewal/minor modification was issued for the addition of seven (7) floating docks.
The NC Division of Water Quality's water classification for Middle Sound is SA-ORW in the project area. The
waters are CLOSED for shellfish harvest. This area of Middle Sound is NOT designated as a primary nursery
area (PNA), by the NC Division of Marine Fisheries.
The applicant is proposing the construction of one 8' x 204' floating dock and six 4' x 24' finger docks on the
southern side of the boat basin between the existing floating docks and the clubhouse/marina, which would
bring the total number of floating docks to fifty-six (56), or 100 slips. Water depths in the area of the proposed
slips would be between -3 and -5 feet at normal low water.
There has been a great deal of controversy regarding the total number of slips at the Figure Eight Island Yacht
Club. The applicant indicates that there are currently eighty-eight (88) slips at the marina, however personnel
from the Division of Coastal Management have determined that there are currently ninety (90) slips available
for dockage. The applicant is proposing the addition of twelve (12) docks, however, given the total number of
slips, this would put the marina over their limit of 100 slips established by Shellfish Sanitation.
10. ANTICIPATED IMPACTS
Impacts resulting from the development plan include approximately 2,208 square feet of disturbed area by the
construction activities. Construction of the proposed floating docks would incorporate and shade 2,208 square
feet of shallow bottom, estuarine waters and public trust area.

THIS AGREEMENT, made and entered into this the 1st day of January,
1986, by and between FIGURE "8" BEACH HOMEOWNERS' ASSOCIATION, INC., a
'North Carolina non-profit corporation (hereinafter referred to as
"Association"), party of the firs,: part; and FIGURE EIGHT ISLAND CLUB,
INC., a North Carolina non-profit corporation (hereinafter referred to
as "Club"), party of the second part.
WITNESSETH:
THAT WHEREAS, Club is the owner of certain real property.located on
or about Figure Eight Island, New Hanover County, North Carolina known
as the Causeway Tract described in that certain limited warranty deed
recorded in Book 1231 at Page 735 of the New Hanover County Registry,
from The William Lyon Company to Figure Eight Island Club, Inc., a
portion of which has been conveyed by deed of even date herewith to the
Association; and,
WHEREAS, incompliance with an Agreement dated March 15, 1985
between the parties hereto, the Club agreed to restrict the utilization
of the Causeway Tract that remains titled in its name; and,
WHEREAS, this Agreement is to impose restrictive covenants upon the
Causeway Tract described in Exhibit "A" hereto.
NOW, THEREFORE, the Club, for and in consideration of the premises,
in order to comply with the AgreetLzerit dated March 15, 1985 and other
valuable considerations, the receipt of which is hereby acknowledged,
warrants that it is the owner of the Causeway Tract described in the
attached Exhibit "A" which is incorporated herein by reference, and the
Club for itself, its successors and assigns, covenants and agrees with

shall not be further developed for residential or commercial purposes;
provided, however, that this prohibition against commercial use shall
not prohibit the Club from engaging in or allowing use of the Yacht Club
as a real estate sales and rental office nor shall it prevent the Club
from engaging in or in allowing other commercial ventures or operations
for the use and benefit of its members and member's guests. Furthermore,
this prohibition shall not prohibit the utilization of the Yacht Club
facilities on the Causeway Tract nor the expansion, modification or
further utilization of the Causeway Tract for the Club's use, purposes
and goals.
These restrictions shall run with the land known as the Causeway
Tract and described in the attached hereto marked Exhibit "A" and
incorporated herein by reference.
