HomeMy WebLinkAbout20081426 Ver 1_Application_20080918a_ d ?? o STATE OF NORTH CAROLINA Sr p ? ? o'r?j E Otr., } V DEPARTMENT OF TRANSPORTATION MICHAEL F EASLEY LYNDO TIPPETT GOVERNOR September 12, 2008 SECRETARY Mr Brian Wrenn Division of Water Quality 081426 401/Transportation Permittmg Unit -- 1650 Mail Service Center Raleigh, NC 27699-1650 SUBJECT Secondary Road Paving/Pipe Replacement, SR 1812 (Tutterow Road), Iredell County Dear Mr Wrenn The North Carolina Department of Transportation proposes to replace an existing pipe at Station 12+75 in conjunction with a secondary road paving project on SR 1812 (Tutterow Road) in Iredell County NCDOT proposes to replace existing deteriorating 72" x 44", 40-foot CMPA with a 73" x 55", 50-foot long CMPA with inlet headwall A large scourhole (-15 feet wide x -15 feet long) is located at the existing pipe outlet Shot rock will be embedded into the scourhole in an effort to prevent further scour and to provide energy dissipation The proposed pipe will be buried one foot below the "normal" bed elevation located immediately downstream of the scourhole Due to the alignment of the upstream channel, the headwall will extend parallel to the stream and ten feet of riprap will be utilized for structure stabilization and will be positioned in such a way so as not to narrow the normal upstream channel width (-5 feet) Temporary cofferdams/pumping system will be used to divert the stream around the site during construction All areas affected by temporary cofferdams will be restored back to pre-project conditions The total scope of the work will result in 35 feet of permanent to an unnamed tributary to Buck Shoals Branch, which is classified as WS-III Watershed by the Division of Water Quality The project area is not located within '/z mile of any critical watershed area SR 1812 is not a rural or urban arterial, therefore, hazardous spill basins are not required Enclosed is the hazardous spill basin checklist Based upon correspondence with the State Historic Preservation Office (SHPO), dated 4/24/06, the proposed project area has been reviewed and SHPO has determined that no historic properties will be affected (ER Number 06-0936) This office has conducted a GIS and field survey for the project threatened/ endangered species The federally listed species for Iredell County (USFWS list dated January 16, 2008) include the dwarf-flowered heartleaf (Hexastylis naraflora) and the bog turtle Post Office Box 47 Shelby, North Carolina 28151-0047 SR 1812, Tutterow Road Page 2 September 12, 2008 (Clemmys muhlenbergu) The Natural Heritage Program records document the nearest dwarf-flowered heartleaf location approximately 29 6 miles southwest of the proposed project in Catawba County The heartleaf is usually found on dry to moist ravine slopes (usually north facing and of the oak-hickory-pine forest type) and in boggy areas near springheads The project area is mostly cultivated agricultural land with some forested land There is potential habitat within the proposed project area, but no species were observed The Natural Heritage Program records document the bog turtle location approximately 4 2 miles southwest of the proposed project Bog turtles are typically found in bogs, marshes, and wet pastures There is no suitable habitat located within the project area No impact on this species is anticipated NCDOT is recommending a fmdmg of "no effect" for T&E species I have enclosed a pre-construction notification for a NW#14, sketches of planned activities and location maps relative to the project Project information for the 401 Automated Payment Procedure is as follows 0 Work order number 150465-55120005-12C 049073-3368 • TIP# NA • Project Category $240 00 Fee If you have any questions or concerns please feel free to contact me at (704) 480-9044 Thank you for your time and consideration on this matter Respectfully yours, M L Holder, P E Division Engineer Twelfth Division BY .- Trish Simon Division 12 Environmental Supervisor Enclosures cc Polly Lespinasse, Division of Water Quality Office Use Only' Form Version March 05 USACE Action ID No. DWQ No. 2 0 0 8 1 4 2 6 (If any particular item is not applicable to this project, please enter ivot Hppiicaoie or N/A 1. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible Also discuss how impacts were minimized once the desired site plan was developed If applicable, discuss construction techniques to be followed during construction to reduce impacts There will be a minimal increase in mne length with the utilization of the upstream headwall _ Additionally, the large rock which is to be embedded into the existma downstream scourhole will provide energy dissipation and prevent further stream scour at that location during high stormflows VIII. Mitigation DWQ - In accordance with 15A NCAC 2H 0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams Page 5 of 8 (V , USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on January 15, 2002, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed Examples of mitigation that may be appropriate and practicable include, but are not limited to reducing the size of the protect, establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams, and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing Any application lacking a required mitigation plan or NCEEP concurrence shall be placed on hold as incomplete An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http //h2o enr state nc us/ncwetlands/stnngide html 1 Provide a brief description of the proposed mitigation plan The description should provide as much information as possible, including, but not limited to site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e g , deed restrictions, conservation easement, etc), and a description of the current site conditions and proposed method of construction Please attach a separate sheet if more space is needed MITIGATION NOT ANTICIPATED 2 Mitigation may also be made by payment into the North Carolina Ecosystem Enhancement Program (NCEEP) Please note it is the applicant's responsibility to contact the NCEEP at (919) 715-0476 to determine availability, and written approval from the NCEEP indicating that they are will to accept payment for the mitigation must be attached to this form For additional information regarding the application process for the NCEEP, check the NCEEP website at http //h2o enr state nc us/wrp/index htm If use of the NCEEP is proposed, please check the appropriate box on page five and provide the following information Amount of stream mitigation requested (linear feet) Amount of buffer mitigation requested (square feet) Amount of Riparian wetland mitigation requested (acres) Amount of Non-npanan wetland mitigation requested (acres) Amount of Coastal wetland mitigation requested (acres) IX.
