Waddell, CPA Executive Director r=3 (i::4?OWI[4 AUG 2 9 2008 DENR - WATER QUALITY WETLANDS AND STORMWATER BRANCH The North Carolina Global TransPark Authority (Authority) received an Individual Section 404 permit (Action ID #199202851) from the U.S. Army Corps of Engineers (USACE) on October 21, 1998 to discharge dredged or fill material into waters of the United States for the initial construction of Global TransPark (GTP) facilities and infrastructure. The permit allows for 871 acres of jurisdictional impact. This permit was supported by a comprehensive Environmental Impact Statement (EIS) prepared for the project dated July 1997 and approved by the Federal Aviation Administration and USACE. The Authority has worked diligently to solicit tenants and complete infrastructure in keeping with the intent of the project as outlined in the EIS, including efforts to complete wetland mitigation commitments (4,600 acres) expressed in the detailed mitigation plan accompanying the EIS. Although work is continuing at the GTP, only a fraction of the permitted impacts within jurisdictional systems has occurred to date (125.2 acres). Currently, the permit will expire on October 21, 2008. Therefore, on behalf of the Authority, I respectfully request extension of the existing 404 permit until October 21, 2018 to allow the GTP's activities to proceed as planned. In addition, the North Carolina Division of Water Quality (NCDWQ) issued 401 Water Quality Certification (#970093) for the GTP project on April 7, 1998. The 401 Certification runs concurrent with the GTP. 404 permit and will also expire on October 21, 2008. Od12 p !',,UG 2 9 2008 DENR - WATER QUALITY k,?ETLAF:OS AND STORMWATER BRANCH Re: NCGTP Mitigation Lands Substitution Action ID# 199202851 Dear Mr. Lekson: The North Carolina Global TransPark Authority (Authority) has been working diligently to complete mitigation commitments outlined in the Detailed Mitigation Plan (dated January 1997) that accompanied the Individual Section 404 permit issued for the North Carolina Global TransPark (GTP) project on October 21, 1998. This commitment involves approximately 4,600 acres of lands targeted for restoration, enhancement, or protected as preservation. The first phase of GTP mitigation, involving approximately 3,500 acres, has been completed. This work included restoration of the 3,100-acre Dover Bay complex, as well as floodplain protection, enhancement, and stream restoration involving approximately 365 acres in the Stonyton Creek system at the GTP site. Phase two of the mitigation was originally targeted toward enhancement and protection of approximately 1,100 acres of interstream flats on or adjacent to the GTP site and linkages with riverine systems through a series of wildlife corridors. The Authority has made a concerted effort to acquire phase two lands from willing landowners. Twenty-nine landowners involving 40 parcels have been contacted. Of those landowners contacted, 42 percent were not interested in selling. Approximately 15 landowners (53.5 percent) were interested in selling, but only at above market prices. The problems with mitigation acquisition were reported to you and your staff at meetings held in September 2007 and May 2008. Additionally, the Authority's Board of Directors (Board) was briefed on this issue at a meeting on May 27, 2008. As a result of these acquisition difficulties and direction from the Board, the Authority has sought other mitigation alternatives to complete the GTP commitment. An 1,100-acre site, Frog Hollow property located in west central Craven County, has been identified as a potential alternative mitigation site (Figures 1 and 2). Frog Hollow is positioned within the same Neuse River Hydrologic Unit (03020202) as the GTP site and offers similar functions as the GTP proposed mitigation. FAX (252) 522-5778 Page 2 August 26, 2008 provide enhanced wildlife habitat, with improvements to water quality as a secondary consideration. The Frog Hollow site provides these functions. In addition, Frog Hollow is registered with the North Carolina Natural Heritage Program as a "Significant Natural Area" and is immediately adjacent to more than 2,650 acres of Neuse River riparian land managed by the North Carolina Coastal Land Trust. Incorporation of the Frog Hollow site into the GTP mitigation program will result in the permanent protection of more than 3,700 contiguous acres of pristine floodplain and riparian community. These acreages will contribute to the GTP plan of providing enhanced environmental functions and benefits on a regional basis. Our commitment to completing needed mitigation at the GTP has remained unchanged. In order to move this process forward, I request your review and consideration of the proposal to have the Frog Hollow site incorporated into our mitigation program. If you approve of this proposal, the Board has agreed to purchase this site. To avoid the use of eminent domain and have a site that is an alternative to the original plan is very positive for the Authority.
