On September 29, 2015, Duke Energy and the Department of Environmental Quality (DEQ)
entered into a settlement agreement which, in part, required Duke Energy to implement
accelerated remediation at four sites, including the H.F. Lee Plant, "...that demonstrated offsite
groundwater impacts in isolated areas that are not impacting private wells..."
At the HF Lee Plant, Duke Energy has recently acquired the property to the east of the ash
basin where offsite impacts were identified and reported in the Comprehensive Site
Assessments. As a consequence, there is no longer known offsite contamination at this site.
On April 12, 2017, Duke Energy received written confirmation from your office stating that
"Division of Water Resources agrees to allow Duke to forego the installation of the interceptor
wells for the time being and to focus efforts on closure of the impoundment through ash
removal." Therefore, the activities related to design, review, permitting, and implementation of
the Interim Action Plan Accelerated Remediation are being discontinued.
Groundwater monitoring wells will be installed near the eastern edge of this new parcel to
assess and evaluate the area for impacts to water resources. Any groundwater impacts
attributed to coal ash that are observed in this area will be addressed as part of the site -wide
CAMA-required corrective actions in accordance with an approved CAMA Corrective Action
Plan.
