Ellis, III Town Manager, Town of Fuquay-Varina 401 Old Honeycutt Road Fuquay-Varina, NC, 27526 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Ellis: You have our approval, in accordance with the attached conditions, to place permanent fill in 0.45 acre of wetl rids in order to construct two road crossings associated with the Lakestone Parkway project in Wake County, as described in your application received by the Division of Water Quality on May 30, 2003. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3404, which can be viewed on ou web site at htto://h2o.enr.state.nc.us/ncwetiands. This Certification allows you to use Nationwide Permit Number 14 wh n it is issued by the U.S. Army Corps of Engineers.. This approval is also valid for the Neuse River Buffer Rules (15A NC C 2B .0233). In addition, you should get any other federal, state or local permits before you go ahead with your project in luding (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also t is approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certificat n. This approval is only valid for the purpose and design that you described in your application. If you change yo r project, you must notify us in writing and you may be required to send us a new application for a new certification. I the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby respons ble for complying with all conditions. If total wetland and/or stream fills for this project (now or in the future) including futur phases of this subdivision exceed one acre or 150 linear feet of perennial streams, compensatory mitigation may be requir d as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the atta hod certification, as well as the additional conditions listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included ih the 401 Certification has been completed; 2. The culvert required for this project shall be installed in such a manner that downstream profiles are not altere (i.e. the depth of the channel must not be reduced by a widening of the streambed). Existing stream dimensions (inclu ing the pattern and profile) are to be maintained above and below locations of each culvert. The culverts shall be desi ned and installed to allow for aquatic life movement as well as to prevent head cutting of the streams. If any of the exis ing pipes are or become perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perc ed manner, the pipes shall be removed and re-installed correctly. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You ust act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, Mail Service Center 6714, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. We also request written concurrence from the North Carolina Division of Water Quality (NC-DWQ) that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 14. A Pre-construction Notification Application (PCN) is attached, as well as an agent authorization form. The proposed project consists of the construction of Lakestone Parkway, a proposed road that is included Town of Fuquay-Varina's Thoroughfare Plan (see attached). The proposed Lakestone Parkway is approximately 3300 linear feet in length and will connect US 401 to Old Honeycutt Road (SR 2765) (see Fig. 3). The location of the proposed corridor is depicted on the attached USGS map (Fig. 1) and Soil Survey map (Fig. 2). S&EC conducted a delineation of the proposed corridor for Lakestone Parkway and the surrounding area in 2002. Ms. Amanda Jones approved this delineation on 12/9/02 (AID 200220660). In a letter dated January 10, 2003, Ms. Deborah Edwards of NC-DWQ determined that feature B becomes subject to the buffers at flag 110, downstream from impact #2 (see soil survey map and attached plan). Feature A was ddterinined to be-.xot subject to the buffers. No permits have been requested for this project prior to this application. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The applicant requested a delineation of wetlands in the vicinity of the proposed Lakestone Parkway corridor in order to minimize impact to jurisdictional features to the maximum extent practical Lakestone Parkway is a proposed collector street shown on the Town of Fuquay- Varina Thoroughfare Plan that will connect US 401 / Main Street to Old Honeycutt Road (SR 2765) Two wetland features separate Old Honeycutt Road from US 401, making it necessary to impact both jurisdictional areas in order to provide the connection required by the thoroughfare plan In an effort to minimize impact, the project engineer has aligned the proposed parkway to cross both wetland features perpendicularly at their narrowest points (see attached plan) and avoid the strea channel and riparian buffer at impact area #2. S&EC believes that the applicant has aligned the thoroughfare to minimize impact to wetlands and avoid stream channels and riparian buffers to the maximum extent practicable However, if the USACE determines further mitigation is necessary, the applicant proposes payment into the NCWRP and / or preservation of wetland areas in the vicinity of Lakestone Parkway at a ratio of 5:1. On August 27, 2002, 1 conducted a site visit of features A, B, C and ponds 1, 2 and 3 involved in the above referenced project as identified on the attached figures 1 and 2. It was determined that the features shown on the Wake County Soil Survey and on the USGS Fuquay- Varina, NC Quad map could potentially be subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A: 0213.0233 (NCAC .0233). Features A and C are not subject. Feature B is subject from flag 110 to flag U42. Ponds 1, 2 and 3 are all subject. This letter only addresses the applicability of the Neuse Buffer Rules.
