NORTH CAROLINA DEPARTMENT OF TRANSPORTATION
REPLACEMENT OF BRIDGE NO. 14 OVER TOWN FORK CREEK AND
BRIDGE NO. 44 OVER TOWN FORK CREEK OVERFLOW ON NC 8, STOKES
COUNTY
NORTH CAROLINA DIVISION OF WATER QUALITY
PUBLIC NOTICE is hereby given that THE NORTH CAROLINA DEPARTMENT OF
TRANSPORTATION has applied to the North Carolina Division of Water Quality for an
Individual Section 401 Water Quality Certification pursuant to Environmental
Management Commission rules in 15A NCAC 2H .0500. The activity for which this
Permit is sought is temporary fill of 0.01 acres in surface waters (Town Fork Creek) to
replace Bridge No. 14 and Bridge No. 44 on NC Hwy 8 in Stokes County near the town
of Germanton.
The public is invited to comment in writing to the Division of Water Quality on the
above-mentioned application. Comments shall be sent to the N.C. Division of Water
Quality, Transportation and Permitting Unit, 2321 Crabtree Blvd., Raleigh, NC, 27604,
Attn: John Hennessy (Phone 919-733-5694, FAX: 919-733-6893). Comments must be
received by DWQ by xxxxxx. A copy of the application is on file at the DWQ Winston-
Salem Regional Office at 585 Waughtown St., Winston-Salem, North Carolina, 27107

normal business hours and may be inspected by the public.

SUBJECT: NCDOT's proposal to replace Bridge Nos. 14 and 44 on NC 8 over Town Fork
Creek and Overflow, Stokes County, North Carolina. TIP No. B-4280.
North Carolina Department of Transportation (NCDOT) is proposing to replace Bridge Nos. 14
and 44 on NC 8 over Town Fork Creek and Overflow in the Dan River watershed and is
applying for an Individual Permit for the project. Only one of the two bridges being replaced is
over a live stream. These comments are provided in accordance with the provisions of the
National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d).
The North Carolina Wildlife Resources Commission (NCWRC) has provided comments on the
subject project, the most recent dated November 7, 2005. These comments remain appropriate
for the project. NCWRC staff has also participated in a meeting with the N.C. Division of Water
Quality and NCDOT regarding the project in which additional supportive information was
presented. The additional supportive materials included a list of the non-game species found at
or near the project, their tolerance ratings, spawning dates and temperatures, and life expectancy.
It is important to note that many of the species had a life expectancy in the two to four year
range, potentially making the loss of one year of spawning a significant impact to the population.
Some of these species are only found in the Dan River drainage in North Carolina and the
Roanoke basin in Virginia, and no where else in the world.
In addition, the supplemental information indicated that seven of the fish species are considered
Priority Species in the North Carolina Wildlife Action Plan, including the Roanoke hogsucker
(Hypentelium roanokenese), state listed as Significantly Rare, which was not mentioned in our

previous comment letter. A number of fish species in the project area are known to be host fish
for the five state-listed mussel species (three with federal status) found in the Dan River Basin in
N.C. that are considered Priority Aquatic Species in the Wildlife Action Plan.
We maintain that the project area contains a unique, diverse, high quality fishery resource that
should be protected as outlined in our previous comments. Sedimentation should be avoided to
the maximum extent possible and in-stream disturbance should be prohibited from February 1
through June 30 to protect spawning fishes of the project vicinity.
