Thomas, Jr., NCDOT Coordinator Raleigh Regulatory Field Office, USACE FROM: Marla Chambers, Western NCDOT Permit Coordinator`` C~ct"m; Habitat Conservation Program, NCWRC DATE: April 17, 2008 SUBJECT: Review of NCDOT's application for a Section 404 Permit and 401 Water Quality Certification for the proposed widening of US 70 to a multi-lane facility from the Rowan/Iredell County line to SR 1001 (Amity Hill Road). Rowan County. TIP No. R-2911 B. North Carolina Department of Transportation (NCDOT) has submitted an application to obtain a Section 404 Permit from the U.S. Army Corps of Engineers (USACE) and a 401 Water Quality Certification from the Division of Water Quality (NCDWQ). Staff biologists with the North Carolina Wildlife Resources Commission (NCWRC) have reviewed the information provided. These comments are provided in accordance with the provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The NCDOT proposes to widen US 70 to a multi-lane facility from the Rowan/Iredell County line to SR 1001 (Amity Hill Road). The project includes replacing the existing bridge over Third Creek with dual bridge structures that will span Third Creek. Permanent stream impacts total 250 linear feet to two unnamed tributaries (UTs) to Third Creek. Temporary stream impacts totaling 0.04 acres are proposed due to the use of two causeways for bridge construction. Permanent riverine wetland impacts of <0.1 acre are expected. Only clean, sediment-free rock should be used as temporary fill (causeways), and should be removed without excessive disturbance of the natural stream bottom when construction is completed.
