HomeMy WebLinkAbout20080915 Ver 3_SC DHEC - Public Notice_20160930South Carolina Department ofHealth and Environmental Control (DHEC), Bureau of Water Public Notice Number DHEC-O8{-BO1(Revsed) September 30,ZO1G DHEC received an application from Duke Energy (Duke) pursuant to Section 401 of the Clean Water Act(33 U.S.C. 1341) toamend the Water Quality Certification (VVQ[) DHECO8'C-UQ1 (Revised) issued for the Catawba-VVmtenee Hydroelectric Project (Project) on February 12, 2015. The Federal Energy Regulatory Commission (FERC) issued a new operating license for the Project (FERC Project No. 2232) on November 25, 2015 that incorporates requirements of the subjectVV0C. An amendment ofthe subject VVOC is necessary due to changes listed below. These changes affect sections and appendices of the Catawba- VVabcreeComprehensive Re|icensingAgreement (CRA) dated December 22, 2U06that are incorporated by reference asspecial conditions ofthe subject VVOL 1. CRA Parties have found it to be beneficial to improve regional drought resiliency by raising reservoir summer target elevations on Lakes James, Norman, and Wylie by an additional 6" from May 1 — October 1 and to make a public safety improvement by modifying the 6,000 cubic feet per second (ds) recreation flow release from the Wylie Development to 3,080cfs. 2. Duke hos voluntarily initiated revisions to update the Low lmMmw Protocol (LIP) and the Maintenance and Emergency Protocol (MEP) in accordance with the [RA based an experience gained during voluntary implementation ofthese protocols since 2OO6. 3. The license for the Project requires Duke to file both a Water Quality Monitoring Plan (VVOMP) and a Flow and Water Quality Implementation Plan (RWQIP). These plans are presented in CRA Appendices F and L respectively. During the time since these CRA provisions were developed in 2006, some of these provisions, their status and implementation schedule have changed.
