Subject: Re: Submittal of Duke's proposed process to address water supply provisions of HB630
Dear Mr. Sideris,
Thank you for your September 7 letter regarding Duke Energy's proposed process to address the water
supply provisions of HB630. Generally speaking, the Department agrees in principle with the process you
laid out in your letter, although it reserves the right to utilize the discretion inherently allowed the
Department by HB630 in actual implementation. However, there are some points which the Department
would like to clarify based on the statutory requirements of HB630:
First, please be aware that, barring any cost -prohibitive circumstances, the customer shall have the final
say as to whether they desire a public water supply connection, a whole house filtration system, or no
water changes whatsoever.
Second, the Department understands how Duke arrived at the proposed $35,000 amount for whether a
connection is cost -prohibitive and agrees that this is an acceptable planning value for the purposes of the
initial proposed plan. In the event that a proposed plan applies this economic threshold, the proposal
should include detailed calculations for how the projected cost was reached. This threshold may be
adjusted if the per resident costs of previous municipal extensions vary significantly.
Additionally, the Department agrees to provide final approval within 30 days of receipt. Approval of any
proposed plan, if granted, will contain a provision that such approval is subject to any changes resulting
from the residents' option selection or force majeure beyond the control of Duke Energy
