Tosto Rd.. Beaufort , as requested in the permittee's letter dated 4/29/08, including the
attached workplan drawing (1) dated "received Morehead City 5/5/08"
This permit, issued on June 5, 2008 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this minor modification authorizes the grading and filling of the area
indicated on the attached workplan drawing. Any additional land disturbing activities and/or
construction may require a modification of this permit. Contact a Division of Coastal Management
representative at [phone] for this determination.
2) No vegetated wetlands shall be filled as a result of this modification, even temporarily.
(See attached sheet for Additional Conditions)
1'his permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit shall be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work shall cease when the permit expires on
December 31, 2011

In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal

ADDITIONAL CONDITIONS
3) The permittee shall take every precaution to ensure that no fill is placed on the neighboring property to
the south. Any fill inadvertently placed on the neighboring property shall be removed immediately.
4) The fill material shall be clean and free of any pollutants except in trace quantities.
5) No new impervious surfaces shall be placed within 30 feet of the normal water line.
General
6) This minor modification shall be attached to the original of Permit No. 55-08, which was issued on
4/9/08 and copies of both documents shall be readily available on site when Division personnel inspect
the project for compliance.
7) All conditions and stipulations of the active permit remain in force under this minor modification, unless
specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
